Ochrona praw osób z albinizmem w Tanzanii w świetle standardów międzynarodowych i orzecznictwa Afrykańskiego Trybunału Praw Człowieka i Ludów

W pracy przeanalizowano sytuację osób z albinizmem w Tanzanii w kontekście ochrony ich praw człowieka na podstawie międzynarodowych standardów oraz wyroku Afrykańskiego Trybunału Praw Człowieka i Ludów z 2025 roku. Wywody koncentrują się na wpływie mechanizmów międzynarodowych, w tym orzecznictwa trybunału oraz działań organizacji międzynarodowych, na politykę rządu Tanzanii wobec tej grupy społecznej, szczególnie w świetle fali przemocy od 2007 roku. Praca przedstawia kontekst i historię rozwijającej się agresji wobec osób z albinizmem, reakcję rządu i społeczności międzynarodowej. Dokonano szczegółowej analizy wyroku Trybunału w sprawie Centre for Human Rights & Others v. United Republic of Tanzania oraz tanzańskiego planu polityki National Action Plan for Persons with Albinism (2024/2025 – 2028/2029). Analiza wykazała, że National Action Plan w dużej mierze odpowiada zaleceniom sformułowanym przez Trybunał, choć powstał przed wydaniem wyroku, co wskazuje na jego funkcję wzmacniającą już wcześniej obrany kierunek reform, a nie inicjującą. Praca zwraca również uwagę na niedociągnięcia planu, w tym brak mechanizmu kompensacyjnego dla ofiar przemocy oraz na ograniczony, choć realny wpływ organizacji międzynarodowych i orzecznictwa regionalnego na kształtowanie polityki rządu Tanzanii wobec osób z albinizmem.

Abstrakt (EN)

This paper analyses the situation of people with albinism in Tanzania in the context of the protection of their human rights, based on international standards and the 2025 judgment of the African Court on Human and Peoples’ Rights. The discussion focuses on the impact of international mechanisms, including the Court’s case law and the actions of international organisations, on the Tanzanian government’s policy towards this social group, particularly in light of the wave of violence since 2007. The thesis presents the context and history of the escalating aggression against people with albinism, as well as the response of the government and the international community. A detailed analysis was carried out of the Court’s judgment in the case of Centre for Human Rights & Others v. United Republic of Tanzania and Tanzania’s National Action Plan for Persons with Albinism (2024/2025–2028/2029). The analysis showed that the National Action Plan largely corresponds to the recommendations made by the Court, although it was drawn up before the judgment was handed down, which indicates that its function is to reinforce the direction of reforms already adopted, rather than to initiate them. The paper also highlights the plan’s shortcomings, including the lack of a compensation mechanism for victims of violence, and the limited, albeit tangible, influence of international organisations and regional case law on the shaping of the Tanzanian government’s policy towards people with albinism.
