Standardy konstytucyjne przepisów regulujących odpowiedzialność dyscyplinarną funkcjonariuszy Policji.

Abstrakt (PL)

Niniejsza praca magisterska stanowi analizę prawną odpowiedzialności dyscyplinarnej funkcjonariuszy Policji w Polsce. Punkt wyjścia pracy stanowi omówienie zagadnienia odpowiedzialności dyscyplinarnej w polskim systemie prawnym, ze wskazaniem jej celów i funkcji. W ramach tego zostały omówione także najważniejsze standardy konstytucyjne i orzecznictwo Trybunału Konstytucyjnego, a także modele odpowiedzialności dyscyplinarnej. W dalszej części pracy autor skupił się głównie na modelu odpowiedzialności dyscyplinarnej w Policji oraz tym jak procedura ta została ukształtowana w Ustawie o Policji. W części poświęconej zagadnieniom materialnoprawnym omówione zostały: przewinienie dyscyplinarne (jego struktura, w tym omówienie kwestii winy), kary dyscyplinarne (w tym katalog kar i instytucję zatarcia) oraz dyrektywy ich wymierzania. Zasadnicza część pracy skupia się jednak na gwarancjach procesowych obwinionego policjanta, zapewnianych mu przez Konstytucję RP oraz Ustawę o Policji. Omówione są takie zagadnienia jak: zasada domniemania niewinności, reguła in dubio pro reo, prawo do obrony w wymiarze formalnym i materialnym oraz wynikające z nich zasady i gwarancje (m.in. zasada obiektywizmu, bezpośredniości, swobodnej oceny dowodów, dwuinstancyjności postępowania dyscyplinarnego czy kontrola sądowa).

Abstrakt (EN)

This master's thesis presents a legal analysis of the disciplinary liability of police officers in Poland. The study begins by discussing the concept of disciplinary liability within the Polish legal system, outlining its objectives and functions. This section also addresses key constitutional standards, the case law of the Polish Constitutional Tribunal, and various models of disciplinary liability. Subsequently, the author focuses primarily on the disciplinary liability model applicable to the Police and the procedural framework established by the Police Act. The section dedicated to substantive legal issues covers disciplinary offenses (including their structure and the element of culpability), disciplinary penalties (including the catalogue of penalties and the mechanism for the expungement of a disciplinary record), and the guidelines for imposing such penalties. However, the core of the thesis focuses on the procedural safeguards afforded to the accused police officer under the Constitution of the Republic of Poland and the Police Act. It examines issues such as the presumption of innocence, the in dubio pro reo principle, and the right to a defense—in both its formal and material dimensions—along with the associated principles and guarantees (including the principles of objectivity, immediacy, the free assessment of evidence, the two-instance nature of disciplinary proceedings, and judicial review).
