URLOP MACIERZYŃSKI

Praca dotyczy urlopu macierzyńskiego, przedstawia jego genezę oraz uwarunkowania społeczne. W pracy przedstawiono również przemiany w życiu zawodowym kobiet i przemiany w rodzinie, które miały wpływ na politykę rodzinną i regulacje prawa pracy dotyczące rodzicielstwa. W pracy omówiono zagadnienie podstaw prawnych urlopu macierzyńskiego zarówno na gruncie polskiego ustawodawstwa , jak i prawa międzynarodowego. Podjęto również analizę przesłanki nabycia prawa do urlopu macierzyńskiego jaką jest urodzenie dziecka, w pracy poruszono kwestię urodzeń dziecka żywego, martwego oraz przypadków poronień. Tematem, który jawi się jako ważna kwestia, a który został również przybliżony w poniższej pracy jest rodzicielstwo zastępcze i prawo do urlopu macierzyńskiego w takich sytuacjach. W pracy skupiono się również na przedstawieniu w jak najszerszy sposób osób uprawnionych do korzystania z urlopu macierzyńskiego. Zaprezentowano również zasady, które obowiązują podczas korzystania z urlopu takie jak jego obligatoryjność i ciągłość. Na zakończenie poruszono również kwestię, która sprawia wiele wątpliwości a mianowicie dopuszczalność pracy zarobkowej podczas urlopu macierzyńskiego.

The paper addresses the topic of maternity leave, examining its historical development and the social context in which it emerged. It also considers the changes in women's working lives and the transformations in the family that have influenced the formulation of family policy and labour law regulations concerning parenthood. The paper discusses the legal basis of maternity leave, both under Polish legislation and international law. Furthermore, the paper analyses the conditions for acquiring the right to maternity leave, namely the birth of a child. It also addresses the issue of live birth, stillbirth and miscarriage. Another topic that appears to be an important issue, which is also explored in the following work, is surrogate parenthood and the right to maternity leave in such situations. The paper also focuses on presenting the persons entitled to maternity leave in the broadest possible way. Furthermore, the text presents the principles that apply when taking leave, including its mandatory nature and continuity. Finally, it addresses an issue that causes considerable doubt, namely the permissibility of paid work during maternity leave.
