EFEKTYWNOŚĆ ZAJĘCIA RUCHOMOŚCI W TOKU SĄDOWEGO POSTĘPOWANIA EGZEKUCYJNEGO

Przedmiotem niniejszej pracy jest analiza efektywności zajęcia ruchomości w toku sądowego postępowania egzekucyjnego. Analizie poddano zarówno podstawy prawne egzekucji z ruchomości, jak i praktyczny przebieg postępowania, ze szczególnym uwzględnieniem etapu zajęcia ruchomości, badania prawa własności oraz ochrony praw osób trzecich. Omówiono również sposoby sprzedaży ruchomości oraz pojęcie oszacowania ruchomości. W części empirycznej przeanalizowano dane statystyczne z lat 2014–2024, ze wskazaniem na wyraźny spadek skuteczności egzekucji po nowelizacji przepisów w 2019 roku. W pracy sformułowano również postulaty de lege ferenda, mające na celu zwiększenie efektywności egzekucji z ruchomości przez zmiany legislacyjne i organizacyjne, umożliwiające komornikom sprawne i skuteczne działanie z poszanowaniem praw uczestników postępowania.

The subject of this thesis is an analysis of the effectiveness of movable property seizure in civil court proceedings. The study examines both the legal basis for enforcement against movables and the practical course of the proceedings, with particular emphasis on the stage of seizure, verification of ownership rights, and protection of third-party interests. The thesis also discusses the methods of selling movable property and the concept of valuation. In the empirical part, statistical data from the years 2014–2024 are analyzed, indicating a significant decline in the effectiveness of enforcement following the 2019 legislative amendments. The thesis also formulates de lege ferenda proposals aimed at improving the effectiveness of enforcement against movables through legislative and organizational changes that would enable court enforcement officers to act efficiently and effectively while respecting the rights of all participants in the proceedings.
