Odpowiedzialność inwestora za zapłatę wynagrodzenia podwykonawcy na podstawie art. 647[1] Kodeksu cywilnego-ewolucja instytucji.

Praca magisterska podejmuje tematykę solidarnej odpowiedzialności inwestora i wykonawcy za zapłatę wynagrodzenia podwykonawcy na gruncie art. 647¹ k.c. W pracy dokonano analizy pierwotnego kształtu tej regulacji oraz zmian wprowadzonych nowelizacjami z 2017 oraz 2025 roku. Celem pracy jest ocena ewolucji art. 647¹ k.c. oraz końcowe ustalenie, czy obecny model odpowiedzialności pozostaje spójny z podstawowymi założeniami prawa zobowiązań, przy uwzględnieniu funkcji ochronnej wobec podwykonawców oraz dostatecznej ochrony interesów inwestora. Przeprowadzone rozważania prowadzą do wniosku, że mimo poprawy jakości regulacji art. 647¹ k.c., nadal budzi on istotne zastrzeżenia systemowe i wymaga dalszych nowelizacji albo uchylenia.

This master’s thesis examines the joint and several liability of investor and contractor for the payment of remuneration to subcontractor under the article 647¹ of the Civil Code. The thesis analyses the original form of this provision and the changes introduced by the amendments of 2017 and 2025. The aim of the thesis is to assess the evolution of the article 647¹ of the Civil Code and to ultimately determine whether the current model of liability remains consistent with the fundamental principles of the law of obligations, whilst taking into account the protective function towards subcontractors and the adequate protection of the investor’s interests. The analysis leads to the conclusion that, despite improvements to the quality of the provisions of the article 647¹ of the Civil Code, it still raises significant systemic concerns and requires further amendments or repeal.
