PRAWNOKARNA OCHRONA ZWIERZĄT

Przedmiotem niniejszej pracy jest ochrona zwierząt, ze szczególnym uwzględnieniem ochrony prawnokarnej ze względu na przestępstwo znęcania się nad zwierzętami. W pracy przedstawiono genezę ochrony zwierząt, omówiono problematykę statusu prawnego zwierzęcia oraz źródła prawa regulujące ochronę zwierząt w Polsce z uwzględnieniem idei humanitaryzmu. Szczególną uwagę poświęcono przestępstwu znęcania się nad zwierzętami - problemom wynikającym z jego interpretacji, stronie przedmiotowej oraz podmiotowej przepisu regulującego znęcanie się nad zwierzętami, jak również jakie trudności dowodowe wpływają na skuteczność ścigania sprawców czynów skierowanych przeciwko zwierzętom. Następnie omówiono zróżnicowany poziom ochrony poszczególnych kategorii zwierząt, głównie względem zwierząt dziko żyjących, łownych oraz futerkowych. Poruszony został w tym przypadku aspekt zbiegu przepisów oraz instrumentalne traktowanie przedstawionych rodzajów zwierząt i dlaczego stanowi to problem, który należy bardziej szczegółowo uregulować w prawie, ponieważ konsekwencje jakie z niego wynikają są naprawdę rażące. W pracy omówiono także aspekty prawa Unii Europejskiej odnoszące się do ochrony zwierząt i zasady dobrostanu, a także wpływ wybranego orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej na interpretację przepisów krajowych państw członkowskich. Przedstawiono również analizę prawnoporównawczą standardów ochrony zwierząt obowiązujących we Francji celem wskazania zarówno zbieżności jak i różnic oraz możliwych do wdrożenia rozwiązań dla prawa obowiązującego w Polsce. Celem pracy jest udzielenie odpowiedzi na pytanie w jakim stopniu obowiązujące regulacje prawne rzeczywiście spełniają zakładane przez siebie postulaty ochrony dobrostanu zwierząt. A także jakie problemy są w dalszym ciągu napotykane względem prawnokarnej ochrony zwierząt i co ma rzeczywisty wpływ na skuteczność obowiązujących w tym zakresie regulacji bądź dlaczego są one niewystarczające.

The subject of this thesis is animal protection, with particular emphasis on criminal law protection in relation to the offence of animal cruelty. The thesis outlines the origins of animal protection, discusses the legal status of animals, and examines the sources of law governing animal protection in Poland, taking into account the principle of humanitarianism. Particular attention is paid to the offence of animal cruelty – the problems arising from its interpretation, the objective and subjective elements of the provision regulating animal cruelty, as well as the evidential difficulties affecting the effectiveness of prosecuting perpetrators of acts committed against animals. Subsequently, the varying levels of protection afforded to different categories of animals were discussed, primarily with regard to wild, game and fur animals. In this context, the issue of overlapping provisions was raised, along with the instrumental treatment of the aforementioned types of animals and why this constitutes a problem that requires more detailed regulation in law, as the consequences arising from it are truly egregious. The paper also discusses aspects of European Union law relating to animal protection and welfare principles, as well as the impact of selected case law of the Court of Justice of the European Union on the interpretation of national legislation in Member States. A comparative legal analysis of animal protection standards in force in France is also presented, with the aim of identifying both similarities and differences, as well as feasible solutions for the law in force in Poland. The aim of this paper is to answer the question of to what extent the current legal regulations actually fulfil their stated objectives regarding the protection of animal welfare. It also examines what problems continue to be encountered regarding the criminal law protection of animals, what actually affects the effectiveness of the regulations in this area, and why they are insufficient.
