Opróżnienie lokalu w ramach najmu instytucjonalnego w świetle praw człowieka

Niniejsza praca o tytule „Opróżnienie lokalu w ramach najmu instytucjonalnego w świetle praw człowieka” poświęcona jest instytucji najmu. Celem pracy jest omówienie instytucji najmu lokalu oraz ukazanie różnic pomiędzy najmem okazjonalnym a instytucjonalnym. Omówiono w niej zagadnienia nie tylko definicyjne, ale też związane m.in. z zawarciem i rozwiązaniem różnych rodzajów umów najmu, w tym najmu okazjonalnego i instytucjonalnego. Zawarto w niej analizę najmu instytucjonalnego, jego źródła, zasady zawierania umowy jak i również jakie korzyści wynikają z takiego typu umowy. Jednym z problemów poruszanych w pracy jest ukazanie funkcjonowania i egzekwowania praw wynajmującego i najemcy w czasie pandemii SARS-COV-2. Zawarta w pracy analiza omawianego zagadnienia ukazana jest w kontekście praw człowieka, a także zasad równości stron umowy, zasad sprawiedliwości społecznej oraz godności i prawa do lokalu socjalnego. Praca podkreśla iż najem instytucjonalny wymaga odpowiedzialnego podejścia ustawodawcy w celu odpowiednego zapewnienia zgodności z odpowiednimi regulacjami prawnymi gwarantującymi prawa człowieka.

This paper, titled Eviction of Premises Under Institutional Lease in the Light of Human Rights, is dedicated to the institution of leasing. The aim of the study is to discuss the institution of property leasing and to highlight the differences between occasional leasing and institutional leasing. It addresses not only definitional issues but also topics related to the conclusion and termination of various types of lease agreements, including occasional and institutional leases. The paper includes an analysis of institutional leasing, its origins, the principles of concluding such agreements, as well as the benefits that arise from this type of contract. One of the issues discussed in the study is the functioning and enforcement of the rights of both landlords and tenants during the SARS-COV-2 pandemic. The analysis presented in the paper examines the discussed issue in the context of human rights, as well as the principles of equality between contracting parties, social justice, dignity, and the right to social housing. The study emphasizes that institutional leasing requires a responsible approach by legislators to ensure compliance with relevant legal regulations that guarantee human rights.
