Kontrowersje w sprawie upolitycznienia Policji, Centralnego Biura Antykorupcyjnego i prokuratury w okresie rządów Prawa i Sprawiedliwości w latach 2005-2007.

W dysertacji doktorskiej Autorka podjęła refleksję naukową nad powtarzającą się w demokracji pluralistycznej kolizją między formalnym wymogiem polityczno-partyjnej bezstronności, neutralności, ponadpartyjnej ciągłości i praworządności działania Policji, CBA i prokuratury a ich politycznym uwikłaniem oraz obiektywnym lub subiektywno - intencjonalnym upolitycznieniem ich działania. W pracy udzieliła ona odpowiedzi na pytanie o adekwatność posługiwania się w stosunku do tych instytucji pojęciem apolityczności i formułowanym w przeciwstawieniu - stwierdzeniem o ich upolitycznieniu. Autorka przyjrzała się kontrowersjom leżącym u podstaw regulacji prawnych określających ich status oraz relacje z innymi podmiotami politycznymi. Zakreśliła ona różnicę i granicę pomiędzy naturalnie politycznym charakterem organów państwa (skoro państwo jako takie jest bytem politycznym), metapolitycznym zaprogramowaniem ich funkcji w ustroju demokratycznym opartym na pluralizmie sił politycznych i rotacji sił rządzących oraz upolitycznieniem (zwłaszcza stronniczym i opartym na nadużyciach okresowo sprawowanej władzy) praktyki ich pracy.

In the dissertation the Author has considered the conflict between the formal requirement of the political indifference, the neutrality, the cross – party continuity and the rule of law of work of the Police, the Anti – Corruption Bureau and the public prosecutor’s office, their political involvement and objective or an intentional subjective politicization of their functions. In the PhD thesis the Author gives the answer for the question about the adequacy of using a word “the political indifference” in attitude to these institutions and construction opposite to its term about their “politicization”. The controversies associated with these definitions used in law regulation as the terms of their status and determinants of their relations with other political institution have been analysed. The Author draws a distinction between the natural political character of the organs of political power (as the state is a political subject), giving them the metapolitical status in the democracy (which is associated with the pluralism of the political parties and the rotation of the political powers) and the politicization of their work (especially partial and relating to periodical abuse of the authority).
