Konsularny immunitet jurysdykcyjny w świetle prawa międzynarodowego i prawa polskiego

Praca stara się zobrazować skomplikowany status prawny członków urzędu konsularnego skupiając się na konsularnym immunitecie jurysdykcyjnym. W pracy zostały zdefiniowane i opisane: instytucja konsularnej ochrony jurysdykcyjnej jako taka, podstawy prawne tej ochrony, zasady prawa międzynarodowego dotyczące przywilejów i immunitetów oraz zakres osobowy, terytorialny, czasowy i przedmiotowy konsularnego immunitetu jurysdykcyjnego. Poruszona została także tematyka nietykalności osobistej członków urzędu konsularnego i uprawnień w zakresie składania przez nich zeznań. Spojrzenie na problem dokonane jest głównie z polskiej perspektywy – została więc dokonana analiza obowiązującego Polskę prawa międzynarodowego w tym zakresie oraz polskiego prawa wewnętrznego wcielającego postanowienia obowiązujących konwencji konsularnych.

The thesis tries to illustrate the complicated legal status of members of a consular post, focusing on consular immunity from jurisdiction. The work defines and describes: the institution of consular jurisdictional protection as such, the legal basis for this protection, the principles of international law regarding privileges and immunities, and the personal, territorial, temporal and material scope of consular immunity from jurisdiction. The issue of personal inviolability of members of the consular post and their rights to testify was also discussed. The problem is looked at mainly from the Polish perspective - therefore, an analysis of the international law applicable to Poland in this area and Polish internal law implementing the provisions of applicable consular conventions was made.
