Metody prognozy kryminologicznej w teorii i raktyce sądowej

W niniejszej pracy zaprezentowane zostanie pojęcie “prognozy kryminologicznej” oraz jej kształtowania się w procesie rozwoju nauki. Następnie autorka podejmie próbę zestawienia jej założeń i idei z praktyką sądową. Celem omawianej instytucji jest zbadanie ryzyka powrotu do przestępstwa osób, które weszły już w kolizję z prawem. W części teoretycznej przybliżone zostaną zatem podstawy naukowe, a także szczegółowe wymagania prawne dotyczące szacowania ryzyka recydywy. W części praktycznej zaś opisane zostaną kazusy zaczerpnięte z akt sądowych, w celu dokonania porównania idei instytucji z rzeczywistością i jej realizowaniem przez polski wymiar sprawiedliwości.

This paper will present the concept of 'criminological prognosis' and its formation in the process of scientific development. The author will then attempt to compare its assumptions and ideas with judicial practice. The aim of the institution under discussion is to examine the risk of recidivism of persons who have already come into conflict with the law. In the theoretical part, therefore, the scientific basis will be introduced, as well as the specific legal requirements for estimating the risk of recidivism. In the practical part, case studies taken from court records will be described in order to compare the idea of the institution with the reality and its implementation by the Polish justice system.
