Rola Międzynarodowego Trybunału Sprawiedliwości w stosowaniu prawa międzynarodowego publicznego na podstawie wybranych orzeczeń

Praca podejmuje się analizy roli Międzynarodowego Trybunału Sprawiedliwości w stosowaniu prawa międzynarodowego. W pracy przybliżona została instytucja sądownictwa międzynarodowego oraz pozycja Międzynarodowego Trybunału Sprawiedliwości jako sądu międzynarodowego i organu sądowego Organizacji Narodów Zjednoczonych. Dalej, przedstawione zostały kompetencje i uprawnienia Trybunału oraz jego sposoby orzekania przez Trybunał wraz z formalno-technicznymi aspektami wyroków oraz opinii doradczych. W dalszej części pracy na przykładzie wybranych orzeczeń dotyczących konkretnych zagadnień prawa międzynarodowego ukazany został wpływ orzecznictwa Międzynarodowego Trybunału Sprawiedliwości na rozwój lub zmianę danego zagadnienia prawnego. W ramach konkluzji potwierdzona została hipoteza dotycząca istotnej roli normatywnej Międzynarodowej Trybunału Sprawiedliwości w stosowaniu prawa międzynarodowego, a także podkreślono obecne tendencje prawa międzynarodowego do zwiększania znaczenia Trybunału, prognozując dalszy rozwój roli Trybunału w rozwoju prawa międzynarodowego.

The thesis undertakes an analysis of the role of the International Court of Justice in the application of international law. The thesis introduces the institution of international justice and the position of the International Court of Justice as an international court and judicial organ of the United Nations. Further, the competences and powers of the Court and its methods of adjudication are presented together with the formal and technical aspects of judgments and advisory opinions. In the further part of the thesis, the influence of the jurisprudence of the International Court of Justice on the development or change of a given legal matters is shown on the example of selected judgments on said legal matters of international law. It concludes by confirming the hypothesis on the important normative role of the International Court of Justice in the application of international law, and highlights the current tendency of international law to increase the importance of the Court, forecasting further development of the Court's role in the development of international law.
