Handel ludźmi do pracy przymusowej w ujęciu prawnokarnym i kryminologicznym

Praca dotyczy przestępstwa handlu ludźmi do pracy przymusowej. Starałem się ukazać przestępstwo handlu ludźmi z kilku perspektyw oraz jego prawdziwe oblicze znacznie odbiegające od jego wyobrażenia w wyniku przekazu medialnego, filmów itd. W pierwszym rozdziale przybliżam historię niewolnictwa, które stanowi pewnego rodzaju pierwowzór współczesnego handlu ludźmi. W pierwszym rozdziale przybliżone zostały również definicje handlu ludźmi i pracy przymusowej, a także poruszona została tematyka praw człowieka naruszanych przez przestępstwo handlu ludźmi. Rozdział drugi koncentruje się na statystycznym ujęciu handlu ludźmi na świecie i w Polsce. Przybliżam również zależność między handlem ludźmi a funkcjonowaniem zorganizowanych grup przestępczych. W rozdziale drugim przybliżony został także profil ofiary handlu ludźmi oraz wpływ pandemii COVID-19 na to przestępstwo. W rozdziale trzecim poruszam problem zwalczania handlu ludźmi do pracy przymusowej. W tym celu przybliżona została kwestia identyfikacji ofiar handlu ludźmi ze szczególnym uwzględnieniem czynności dochodzeniowo-śledczych i operacyjno-rozpoznawczych stosowanych przy zwalczaniu handlu ludźmi. Analogicznie do wspomnianej identyfikacji ofiar handlu ludźmi opisana została identyfikacja pracy przymusowej. Opisane zostały również najważniejsze podmioty zaangażowane w zwalczanie handlu ludźmi, a także współpraca międzynarodową w zwalczaniu handlu ludźmi na przykładzie współpracy służb państw członkowskich Unii Europejskiej. Rozdział czwarty zawiera opis metodologii, przebieg oraz analizę wyników badania, mającego na celu ustalenie, jakimi metodami posługują się sprawcy handlu ludźmi do pracy przymusowej. W tym celu przeprowadzono badania, wywiady pogłębione przeprowadzone zostały z obywatelami państw Ameryki Południowej, które padły ofiarami handlu ludźmi.

The master's thesis concerns the crime of trafficking in human beings for forced labor. I tried to show the crime of human trafficking from several perspectives and its true face, which is significantly different from its image as a result of media coverage, films, etc. In the first chapter, I present the history of slavery, which is a kind of prototype of modern human trafficking. The first chapter also presents the definitions of trafficking in human beings and forced labor, and raises the issue of human rights violated by the crime of trafficking in human beings. The second chapter focuses on the statistical approach to human trafficking in the world and in Poland. I also present the relationship between human trafficking and the functioning of organized criminal groups. The second chapter also presents the profile of a victim of human trafficking and the impact of the COVID-19 pandemic on this crime. In chapter three, I discuss the problem of combating trafficking in human beings for forced labor. For this purpose, the issue of identifying victims of trafficking in human beings was presented, with particular emphasis on investigative, operational and reconnaissance activities used to combat human trafficking. Analogously to the above-mentioned identification of victims of human trafficking, the identification of forced labor was described. The most important entities involved in combating human trafficking were also described, as well as international cooperation in combating human trafficking on the example of cooperation between the services of European Union Member States. Chapter four contains a description of the methodology, course and analysis of the results of the study aimed at determining the methods used by perpetrators of trafficking in human beings for forced labor. For this purpose, research was carried out and in-depth interviews were conducted with citizens of South American countries that were victims of human trafficking.
