Proces uzyskania przez inwestora decyzji zezwalającej na realizację inwestycji drogowej

Niniejsza praca magisterska podejmuje tematykę procesu uzyskania przez inwestora decyzji zezwalającej na realizację inwestycji drogowej. Celem pracy jest analiza procesu uzyskania przez inwestora decyzji zezwalającej na realizację inwestycji drogowej (ZRID), wydawanej w trybie tzw. specustawy drogowej. Podniesiony w opracowaniu temat przedstawia podstawy prawne regulujące procedurę, zakres wymaganej dokumentacji jaką musi zgromadzić inwestor oraz rolę organu administracji publicznej prowadzącego postępowanie i tworzone przez niego urzędowe pisma. W pracy omówiono kolejno etapy procesu – od koncepcji planowanej inwestycji poprzez przygotowanie wniosku i prowadzenie postępowania dowodowego, po wydanie i doręczenie decyzji. Poruszono także kwestię środka odwoławczego przysługującego osobom mającym interes prawny. Szczególną uwagę poświęcono zagadnieniom praktycznym, takim jak wywłaszczenie nieruchomości czy ograniczenie w korzystaniu z nieruchomości. Przeprowadzona analiza pozwala ocenić efektywność decyzji ZRID jako narzędzia przyspieszającego realizację inwestycji drogowych oraz wskazać bariery i wyzwania związane z jej stosowaniem w praktyce.

This master's thesis addresses the process of obtaining a permit for a road investment by an investor. The aim of the thesis is to analyze the process of obtaining a permit for a road investment (ZRID), issued under the Special Road Act. The thesis presents the legal basis for the procedure, the scope of required documentation the investor must collect, and the role of the public administration body conducting the proceedings and the official documents it creates. The thesis discusses the stages of the process – from the concept of the planned investment, through the preparation of the application and conducting the evidentiary proceedings, to the issuance and delivery of the decision. The issue of appeals available to persons with a legal interest is also addressed. Particular attention is paid to practical issues, such as expropriation of real estate and restrictions on the use of real estate. The analysis allows for assessing the effectiveness of ZRID decisions as a tool for accelerating the implementation of road investments and identifying barriers and challenges related to their practical application.
