Odpowiedzialność posiłkowa w Kodeksie karnym skarbowym z perspektywy konstytucyjnej zasady indywidualnej odpowiedzialności karnej

Praca podejmuje problematykę odpowiedzialności posiłkowej w Kodeksie karnym skarbowym, analizowanej z perspektywy konstytucyjnej zasady indywidualnej odpowiedzialności karnej. Przedstawiono genezę omawianej instytucji, jej współczesny kształt normatywny oraz relację do odpowiedzialności represyjnej w rozumieniu art. 42 Konstytucji RP. Celem pracy jest ustalenie, czy majątkowe obciążenie podmiotu niewinnego z punktu widzenia prawa karnego skarbowego spełnia wymogi konstytucyjne. W konkluzji wskazano, że odpowiedzialność posiłkowa jest dopuszczalna, jednak wymaga ustawowego uzupełnienia o element indywidualnej winy, rozumianej w ujęciu cywilistycznym.

The thesis addresses the issue of subsidiary liability in the Fiscal Penal Code, analysed from the perspective of the constitutional principle of individual criminal liability. It presents the origins of the institution, its contemporary normative framework and its relationship to repressive liability within the meaning of Article 42 of the Constitution of the Republic of Poland. The aim of the thesis is to determine whether imposing a financial burden on an entity that is innocent from the perspective of fiscal penal law meets constitutional requirements. The conclusion indicates that subsidiary liability is permissible, but requires statutory supplementation with an element of individual fault, understood in civil-law terms.
