Ochrona praw nabywcy w umowie deweloperskiej

Niniejsza praca magisterska ma na celu zbadanie sposobów ochrony nabywcy lokalu mieszkalnego na rynku pierwotnym w świetle prawa polskiego. Jest to tematyka złożona, która ewoluowała na przestrzeni ostatnich lat i która nadal się rozwija, wymaga adaptacji dotychczasowych rozwiązań lub wprowadzenia zupełnie nowych. W tej pracy postaram się przybliżyć i uprościć rzeczoną problematykę poprzez wyodrębnienie z przepisów tych postanowień, które z perspektywy nabywcy będą najważniejsze. W pracy poruszone zostały kwestie dotyczące różnych aspektów umowy deweloperskiej, najbardziej interesujące są te, które będą tworzyły i kształtowały stosunek prawny między nabywcą i deweloperem. Kluczowe jest by przepisy efektywnie pomagały stabilizować ten stosunek oraz wpływać na ochronę praw i interesów nabywcy. Celem pracy jest także krytyczna weryfikacja obowiązujących przepisów i instytucji pod kątem skuteczności ich działania. W pracy zastosowano metody badawcze teoretyczno-prawne oraz dogmatyczno-prawne, jak i analizy wybranych aktów prawnych. Praca wpisuje się w dyskurs związany z doniosłością problematyki zaspokajania potrzeb mieszkaniowych Polaków, jak i z narastającą dynamiką rozwoju sektora budownictwa mieszkaniowego i tym samym rynku pierwotnego. Wskazuje przede wszystkim na wagę idei ochrony nabywcy w stosunkach z deweloperem, czyli patrząc na to szerzej: konsumenta z przedsiębiorcą, dodatkowo często z dużym przedsiębiorcą, ponieważ charakter tej działalności wymaga dużych nakładów finansowych, ekspertyzy i pracy wielu ludzi.

This master's thesis aims to examine measures of protecting the rights of residential property buyers on the primary market in Polish law. This is a complex topic that has evolved over recent years and continues to develop, requiring the adaptation of existing solutions or the introduction of entirely new ones. In this thesis, I will attempt to clarify and simplify this subject matter by isolating the provisions of the regulations that are most crucial from the purchaser's perspective.

The thesis addresses issues related to various aspects of the development agreement, with the most interesting being those that will create and shape the legal relationship between the purchaser and the developer. It is crucial that the regulations effectively help stabilize this relationship and protect the purchaser’s rights and interests.

The thesis also aims to critically scrutinize the applicable regulations and institutions in terms of their effectiveness. The thesis utilizes theoretical and dogmatic legal research methods, as well as an analysis of selected legal acts. This work contributes to the ongoing debate surrounding the importance of meeting the housing needs of Polish people, as well as the growing dynamics of the residential construction sector and, consequently, the primary market. It highlights, above all, the importance of purchaser protection in relationships with developers. More broadly, it highlights the relationship between consumers and businesses, often with large companies, as the nature of this activity requires significant financial outlays, expertise, and the work of many people.
