Instytucja tymczasowego aresztowania w polskim postępowaniu karnym

Praca podejmuje tematykę instytucji tymczasowego aresztowania w polskim procesie karnym, ze szczególnym uwzględnieniem teoretycznych ram prawnych oraz realiów jego praktycznego stosowania. Głównym celem pracy jest ukazanie funkcjonowania tego najsurowszego środka zapobiegawczego w Polsce. Istotną część pracy stanowi szczegółowa analiza przesłanek pozytywnych i negatywnych warunkujących legalność izolacji procesowej. Kluczowym elementem było poddanie krytycznej ocenie polskiej rzeczywistości aresztowej. Na podstawie danych statystycznych przeanalizowany został problem tzw. aresztów wydobywczych, przewlekłości oraz zjawisko nadużywania przesłanki surowości kary jako samodzielnej podstawy pozbawienia wolności. Całość analizy osadzona została w kontekście międzynarodowych standardów ochrony praw człowieka i warunków bytowych w aresztach śledczych.

This thesis examines the institution of pre-trial detention in the Polish criminal proceedings, with particular emphasis on its theoretical legal framework and the realities of its practical application. The main aim of the study is to present the functioning of the most severe preventive measure in Poland. A significant part of the thesis is devoted to a detailed analysis of the positive and negative premises determining the legality of procedural detention. A key element of the research is a critical assessment of the Polish practice of pre-trial detention. Based on the statistical data, the thesis analyses the phenomenon of so-called extractive detention (areszt wydobywczy), the excessive length of pre-trial detention, and the overuse of the severity of the anticipated penalty as an independent ground for deprivation of liberty. The entire analysis is conducted within the context of international human rights standards and the living conditions in Polish remand centres.
