W cieniu Zagłady - Ludobójstwo Jazydów

Praca analizuje zbrodnie popełnione przez tzw. Państwo Islamskie (ISIS) wobec społeczności Jazydów, ze szczególnym uwzględnieniem kwalifikacji tych czynów jako zbrodnia ludobójstwa w rozumieniu prawa międzynarodowego. Przedstawiono genezę i charakterystykę tej grupy, przyczyny oraz przebieg wydarzeń z 2014 r., a także ich skutki humanitarne i społeczne. Na gruncie obowiązujących norm prawa międzynarodowego omówiono definicję zbrodni ludobójstwa, dorobek orzeczniczy oraz proces tworzenia Konwencji z 1948 r. W dalszej części oceniono odpowiedzialność karną członków ISIS, ograniczenia jurysdykcji MTK oraz możliwości ścigania sprawców na poziomie krajowym i w ramach modeli hybrydowych. Analiza prowadzi do wniosku, że działania ISIS wobec Jazydów spełniają przesłanki zbrodni ludobójstwa.

This thesis analyses crimes committed by the so-called Islamic State (ISIS) against the Yazidi community, with particular emphasis on the legal qualification of these acts as the crime of genocide under international law. The study presents the origins and characteristics of the Yazidi group, the causes and course of the events of 2014, as well as their humanitarian and social consequences. On the basis of applicable norms of international law, the thesis discusses the definition of genocide, relevant jurisprudence, and the process leading to the adoption of the 1948 Genocide Convention. The final part examines the criminal responsibility of ISIS members, the limitations of the International Criminal Court’s jurisdiction, and the possibilities of prosecuting perpetrators at the national level and within hybrid justice mechanisms. The analysis leads to the conclusion that the actions of ISIS against the Yazidis meet the legal criteria of genocide.
