Prawna ochrona wizerunku dziecka w Internecie

W niniejszej pracy dokonano analizy obowiązujących przepisów w zakresie prawnej ochrony wizerunku dziecka w Internecie. W pierwszej kolejności, wskazano jak definiowane jest dziecko oraz wizerunek przez przepisy prawa krajowego, doktrynę oraz orzecznictwo. Następnie, omówiono uregulowania prawa krajowego, RODO oraz Konwencję o prawach dziecka, które zawierają przepisy dotyczące wizerunku jako dobra prawnie chronionego. W dalszym toku analizy przedstawiono problematykę wyrażenia zgody na rozpowszechnianie wizerunku dziecka, tego kto jest uprawniony do wyrażenia takowej zgody oraz warunki jej cofnięcia. Na tle powyższych rozważań omówiono zjawiska związane z rozpowszechnianiem wizerunku dziecka przez rodziców tj. zjawisko sharentingu oraz zagrożenia z tym związane. Dalsze rozważania dotyczą problemu publikacji zdjęć uczniów na stronach oraz na profilach prowadzonych przez placówki edukacyjne. W ostatniej części omówiono praktyczne środki ochrony wizerunku dziecka oraz zalecane przez organy dobre praktyki. Wysunięto również postulaty de lege ferenda dotyczące wzmocnienia ochrony prawnej wizerunku dzieci w środowisku cyfrowym.

This master’s thesis analyses the currently applicable legal regulations concerning the protection of a child’s image on the Internet. First, it discusses how the concepts of a child and image are defined in national legislation, legal doctrine, and case law. Subsequently, the study examines the provisions of national law, the GDPR, and the Convention on the Rights of the Child that recognize image as a legally protected interest. Further analysis addresses the issue of consent to the dissemination of a child’s image, including the entities authorized to grant such consent and the conditions for its withdrawal. Against this background, the thesis discusses phenomena related to the dissemination of a child’s image by parents, in particular the phenomenon of sharenting and the risks associated with it. The following considerations concern the publication of students’ photographs on websites and social media profiles operated by educational institutions. The final part of the thesis presents practical measures for protecting a child’s image, as well as good practices recommended by public authorities. It also formulates de lege ferenda proposals aimed at strengthening the legal protection of children’s images in the digital environment.
