Abstrakt (PL)
Niniejsza praca magisterska poświęcona jest instytucji wydziedziczenia w polskim prawie spadkowym, analizowanej zarówno od strony dogmatycznej, jak i przez pryzmat orzecznictwa sądowego. Wydziedziczenie stanowi wyjątek od zasady ochrony dziedziczenia, umożliwiając spadkodawcy pozbawienie najbliższych krewnych prawa do zachowku. Praca obejmuje cztery rozdziały, z których każdy przybliża odrębny aspekt tej instytucji. Rozdział pierwszy ma charakter ogólny i wprowadzający. Omówiono w nim generalne zasady wydziedziczenia, w tym zasadę numerus clausus przesłanek, bezwarunkowość i bezterminowość tej czynności, a także wymóg istnienia przyczyny w chwili sporządzania testamentu i obowiązek jej wskazania. Przedstawiono również zagadnienia wydziedziczenia częściowego, nachodzenia przesłanek na siebie oraz ekonomicznych konsekwencji wydziedziczenia. Wskazano też na inspiracje polskiego ustawodawcy rozwiązaniami praw germańskich, a także zarysowano różnicę między wydziedziczeniem a wyłączeniem od dziedziczenia. Rozdział drugi analizuje pierwszą przesłankę z art. 1008 Kodeksu cywilnego, tj. uporczywe postępowanie uprawnionego do zachowku wbrew woli spadkodawcy w sposób sprzeczny z zasadami współżycia społecznego. Szczegółowo omówiono pojęcie uporczywości, wymóg świadomości uprawnionego, konieczność wyrażenia przez spadkodawcę sprzeciwu, instytucję przebaczenia, a także tzw. wydziedziczenie z życzliwości. Podjęto ponadto rozważania dotyczące obiektywnego i subiektywnego charakteru zasad współżycia społecznego oraz znaczenia wyłącznie zawinionych zachowań jako podstawy wydziedziczenia. Rozdział trzeci dotyczy drugiej przesłanki wydziedziczenia, jaką jest dopuszczenie się przez uprawnionego umyślnego przestępstwa przeciwko spadkodawcy lub osobie mu bliskiej. Przeanalizowano między innymi kwestię niezależności oceny sądu cywilnego od wyroku karnego, granice tej autonomii, zagadnienie kontratypów, a także wpływ czasu jaki upłynął między czynem a wydziedziczeniem. Omówiono też znaczenie wagi przestępstwa, umyślności oraz rażącej obrazy czci. Rozdział czwarty poświęcony jest trzeciej przesłance- uporczywemu uchylaniu się od obowiązków rodzinnych wobec spadkodawcy. Rozważania obejmują zakres pojęcia obowiązków rodzinnych, ich specyfikę w małżeństwie oraz w relacjach między rodzicami i dziećmi, a także kwestię wyłącznej winy uprawnionego. Na tle aktualnego orzecznictwa omówiono wydziedziczenie małżonka oraz analizy dotyczące zdezaktualizowania się przyczyny wydziedziczenia.
Abstrakt (EN)
This master's thesis is devoted to the institution of disinheritance in Polish inheritance law, analyzed both from a dogmatic perspective and through the lens of judicial case law. Disinheritance constitutes an exception to the principle of protection of inheritance, enabling the testator to deprive the closest relatives of their right to a legitim (forced share). The thesis comprises four chapters, each addressing a distinct aspect of this institution.
The first chapter is general and introductory in character. It discusses the general principles of disinheritance, including the numerus clausus principle governing the statutory grounds, the unconditional and indefinite nature of this act, as well as the requirement that the cause exist at the time the will is drawn up and the obligation to state it. The chapter also addresses the issues of partial disinheritance, the overlapping of grounds, and the economic consequences of disinheritance. Furthermore, it points to the influence of Germanic legal solutions on the Polish legislator and outlines the distinction between disinheritance and exclusion from inheritance.
The second chapter analyzes the first ground set out in Article 1008 of the Civil Code, namely the persistent conduct of the person entitled to the legitim contrary to the testator's will and in a manner inconsistent with the principles of social coexistence. It discusses in detail the concept of persistence, the requirement of the entitled person's awareness, the necessity for the testator to express opposition, the institution of forgiveness, as well as the so-called disinheritance out of goodwill. The chapter further considers the objective and subjective character of the principles of social coexistence and the significance of exclusively culpable conduct as a basis for disinheritance.
The third chapter concerns the second ground for disinheritance, namely the commission by the entitled person of an intentional crime against the testator or a person close to them. Among other issues, it analyzes the independence of the civil court's assessment from a criminal judgment, the limits of this autonomy, the question of justificatory circumstances (countertypes), and the influence of the time elapsed between the act and the disinheritance. It also discusses the significance of the gravity of the offense, intentionality, and gross insult to honor.
The fourth chapter is devoted to the third ground—persistent failure to fulfill family obligations toward the testator. The discussion covers the scope of the concept of family obligations, their specific character within marriage and in relations between parents and children, as well as the issue of the entitled person's exclusive fault. Against the background of current case law, the chapter discusses the disinheritance of a spouse and analyses concerning the cessation of validity (obsolescence) of the ground for disinheritance.
