WPŁYW NOWYCH TECHNOLOGII NA FUNKCJONOWANIE ADMINISTRACJI I SĄDÓW ADMINISTRACYJNYCH (ZAGADNIENIA WYBRANE)

Przedmiotem pracy magisterskiej jest analiza wpływu nowych technologii na funkcjonowanie administracji publicznej i sądów administracyjnych. Celem pracy było przedstawienie wzajemnych zależności między wpływem postępu technologicznego a zmianą modelu funkcjonowania organów administracji publicznej, sądownictwa administracyjnego, w tym omówienie znaczenia zastosowania środków komunikacji elektronicznej. Przedmiotem prowadzonej analizy była także kwestia wykorzystania technologii blockchain i zastosowania smart kontraktu dla usprawnienia funkcjonowania administracji publicznej i obrotu gospodarczego. Pierwszy rozdział dotyczy analizy zasad doręczenia elektronicznego pism pochodzących od organów administracji publicznej i zasada komunikacji stron w postępowaniu administracyjnego, a także wydawania decyzji administracyjnych przez organy administracji publicznej i wprowadzania systemu e – doręczeń. Rozdział drugi poświęcony jest analizie zasad komunikacji stron postępowania i zasad doręczania pism w postępowaniu sądowoadministracyjnym, w kontekście zmian wynikających z wejścia w życie ustawy o doręczeniach elektronicznych. Rozdział trzeci dotyczy charakterystyki i omówienia znaczenia technologii blockchain i smart kontraktów dla funkcjonowania administracji publicznej i obrotu gospodarczego. W rozdziale czwartym omówiono zagadnienia procesów cyfryzacji administracji publicznej i sądownictwa administracyjnego oraz problematyki polityki paperless w kontekście wdrażania zarządzania dokumentacją elektroniczną w urzędach administracji publicznej i znaczenia procesów digitalizacji dla zmiany modelu funkcjonowania organów administracji publicznej oraz codziennej pracy urzędników organów administracji publicznej. Najważniejsza konkluzja wynikający z prowadzonej analizy jest taka, że postęp technologiczny jest czynnikiem determinującym zmianę otoczenia regulacyjnego i istotnie wpływającym na zmianę sposobu funkcjonowania administracji publicznej i sądownictwa administracyjnego.

The subject of the master's thesis is the analysis of the impact of new technologies on the functioning of public administration and administrative courts. The aim of the work was to present the interdependence between the impact of technological progress and the change in the model of functioning of public administration bodies and administrative courts, including a discussion of the importance of using electronic means of communication. The subject of the analysis was also the issue of using blockchain technology and the use of smart contracts to improve the functioning of public administration and economic transactions. The first chapter concerns the analysis of the rules for electronic delivery of letters from public administration bodies and the principle of communication between the parties in administrative proceedings, as well as the issuance of administrative decisions by public administration bodies and the introduction of the e-delivery system. The second chapter is devoted to the analysis of the rules of communication between the parties to the proceedings and the rules of serving documents in administrative court proceedings, in the context of changes resulting from the entry into force of the Act on electronic delivery. The third chapter concerns the characteristics and discussion of the importance of blockchain technology and smart contracts for the functioning of public administration and economic transactions. The fourth chapter discusses the issues of digitization processes of public administration and administrative justice, as well as the issues of the paperless policy in the context of implementing electronic documentation management in public administration offices and the importance of digitization processes for changing the functioning model of public administration bodies and the everyday work of public administration officials. The most important conclusion resulting from the conducted analysis is that technological progress is a faktor determining the change in the regulatory environment and significantly influencing the change in the functioning of public administration and administrative justice.
