Praca poświęcona jest problematyce zgody uprawnionego oraz jej znaczeniu w konstrukcji przestępstw przeciwko wolności seksualnej, ze szczególnym uwzględnieniem art. 197 i 199 k.k. Omówiona została konstrukcja zgody, warunki jej skuteczności, zmiany legislacyjne dotyczące przestępstwa zgwałcenia, a także problematyka wykorzystania stosunku zależności, krytycznego położenia oraz nadużycia zaufania małoletniego. Celem pracy jest analiza wpływu zgody na interpretację art. 197 i 199 k.k. oraz ukazanie relacji między autonomią seksualną jednostki a okolicznościami mogącymi wpływać na swobodę procesu decyzyjnego.

This thesis examines the issue of the victim’s consent and its significance in the legal framework of crimes against sexual freedom, with particular emphasis on Articles 197 and 199 of the Polish Criminal Code. It discusses the concept of consent, the conditions for its validity, legislative changes concerning the offence of rape, as well as the issue of exploiting a relationship of dependency, a vulnerable position, and the abuse of a minor’s trust. The aim of this thesis is to analyse the impact of consent on the interpretation of Articles 197 and 199 of the Polish Criminal Code and to demonstrate the relationship between an individual’s sexual autonomy and circumstances that may influence the freedom of the decision-making process.
