Reguły ne peius w kontekście prawa do rzetelnego procesu sądowego

Praca porusza problematykę reguły ne peius w polskiej procedurze karnej. Przedmiotem pracy jest podjęcie próby oceny w jakim zakresie reguła ne peius czyni zadość zasadzie rzetelnego procesu karnego. Autorka pracy pragnie bowiem zbadać, w jakim stopniu istnienie tej regulacji w polskim porządku prawnym wpływa na określenie całego procesu karnego mianem procesu rzetelnego. W wyniku poczynionych w pracy rozważań należy stwierdzić, iż obowiązywanie reguły ne peius nie wynika z Konstytucji, czy prawa międzynarodowego, ale jej całkowite wyrugowanie z systemu mogłoby mogłaby zostać uznane za naruszenie art. 14 ust. 5 MPPOiP. Podsumowując stwierdzić należy, iż kształt normatywny tej regulacji stanowi istotny element prawa do rzetelnego procesu.

The work addresses the issue of the ne peius rule in Polish criminal procedure. The subject of the paper is an attempt to assess to what extent the ne peius rule satisfies the principle of a fair criminal trial. The author of the paper wishes to examine to what extent the existence of this regulation in the Polish legal order affects the description of the entire criminal trial as a fair trial. As a result of the considerations presented in this thesis, it should be stated that the validity of the ne peius rule does not derive from the Constitution or international law, but its complete elimination from the system could be considered a violation of Article 14(5) of the ICCPR. In conclusion, it should be stated that the normative shape of this regulation constitutes an essential element of the right to a fair trial.
