Zintegrowany plan inwestycyjny i ustawa Lex Deweloper w polskim systemie planowania przestrzennego
Abstrakt (PL)
Niniejsza praca poświęcona jest analizie dwóch instrumentów planistycznych, funkcjonujących w polskim systemie prawnym – Zintegrowanego Planu Inwestycyjnego i ustawy o ułatwieniach w przygotowaniu i realizacji inwestycji mieszkaniowych oraz inwestycji towarzyszących z 5 lipca 2018 r., potocznie zwanej Lex Deweloper. Badania poprzedzono rozważaniami na temat historii systemu planowania przestrzennego w Polsce oraz jego obecnego kształtu. Przybliżono tematykę kryzysu mieszkaniowego w Polsce i omówiono instrumenty, którymi ustawodawca posłużył się próbując go rozwiązać. W dalszej części pracy przedstawiono zarys procedur wydania uchwały o ustaleniu lokalizacji inwestycji mieszkaniowej i o uchwaleniu Zintegrowanego Planu Inwestycyjnego na terenie gminy. Porównano charakterystykę inwestycji towarzyszących oraz inwestycji uzupełniających jako dwóch podobnych rozwiązań planistycznych na rzecz gminy. W pracy dokonano również próby podsumowania dotychczasowego funkcjonowania ustawy Lex Deweloper oraz Zintegrowanych Planów Inwestycyjnych. W pracy zawarto ocenę obydwu instrumentów planistycznych oraz podjęto próbę odpowiedzi na pytanie, czy procedura Zintegrowanego Planu Inwestycyjnego stanowi alternatywę dla specustawy mieszkaniowej a także, czy ustawodawca przeprowadzając reformę planistyczną wykorzystał doświadczenia zdobyte podczas funkcjonowania ustawy Lex Deweloper.

This thesis is dedicated to the analysis of two planning instruments operating within the Polish legal system – the Integrated Investment Plan and the Act on Facilitating the Preparation and Implementation of Residential Investments and Accompanying Investments of July 5, 2018, commonly referred to as Lex Developer. The research is preceded by a discussion on the history of spatial planning in Poland and its current structure. The thesis introduces the issue of the housing crisis in Poland and examines the instruments employed by the legislator in an attempt to address it. The subsequent chapters outline the procedures for adopting a resolution on the location of a residential investment and for enacting an Integrated Investment Plan within a municipality. The study compares the characteristics of accompanying investments and supplementary investments as two similar planning solutions serving the interests of local governments. The thesis also attempts to summarize the practical application of the Lex Developer Act and Integrated Investment Plans to date. Furthermore, it provides an evaluation of both planning instruments and seeks to answer whether the Integrated Investment Plan procedure constitutes an alternative to the Lex Developer Act, and whether the legislator, in conducting planning reform, has drawn upon the experiences gained during the implementation of the Lex Developer legislation.
