Przestępstwo stalkingu

Przedmiotem niniejszej pracy jest analiza przestępstwa stalkingu uregulowanego w polskim prawie karnym. Jej celem jest zbadanie, czy regulacja ta stanowi efektywną odpowiedź na zjawisko uporczywego nękania. Powyższemu celowi służy przybliżenie treści kryminologicznej stalkingu, poruszone w pierwszym rozdziale. W rozdziale drugim zbadano, na ile przestępstwo stypizowane w artykule 190a § 1 kodeksu karnego i towarzyszące mu regulacje spełniają standardy wiążącego Polskę prawa międzynarodowego. W rozdziale trzecim przybliżone zostały wybrane uregulowania amerykańskie. W rozdziale czwartym dokonano szczegółowej analizy przestępstwa stypizowanego w artykule 190a § 1 kodeksu karnego w odniesieniu do treści kryminologicznej stalkingu, porównano jego treść z opisanymi uprzednio przepisami amerykańskimi, a także opisano wybrane relewantne aspekty proceduralne oraz instytucje reakcji na przestępstwo, a także zweryfikowano, czy polskie przepisy pozostają zgodne z normami prawa międzynarodowego.

The subject of this thesis is the analysis of the crime of stalking regulated in Polish criminal law. Its purpose is to examine whether this regulation is an effective response to the phenomenon of persistent harassment. The above goal is served by the interpretation of the criminological content of stalking, addressed in the first chapter. The second chapter examines to what extent the crime stipulated in Article 190a § 1 of the Criminal Code and the accompanying regulations meet the standards of international law binding on Poland. Chapter three takes a closer look at selected US regulations. The fourth chapter makes a detailed analysis of the crime stipulated in Article 190a § 1 of the Criminal Code with regard to the criminological content of stalking, compares its content with the American regulations described previously, and describes selected relevant procedural aspects and institutions of response to the crime, as well as verifies whether Polish regulations remain in compliance with international law standards.
