Postępowanie dowodowe w sprawach o rozwód

Celem przygotowanej pracy było przedstawienie postępowania dowodowego w sprawach o rozwód. Po przybliżeniu instytucji małżeństwa, form jego zawarcia oraz przesłanek pozytywnych i negatywnych orzeczenia rozwodu omówione zostały podstawowe regulacje postępowania odrębnego w sprawach małżeńskich. Na bazie instytucji sądowego prawa dowodowego zostały w szczególności przedstawione dowody: z przesłuchania stron, zeznań świadków, wywiad środowiskowy, z opinii biegłego, a także najbardziej dyskusyjne dowody z Facebook, nagrań z rozmów telefonicznych małżonków lub ich korespondencji.

The aim of the prepared work was to present evidence proceedings in divorce cases. After introducing the institution of marriage, the forms of its conclusion and the positive and negative prerequisites for the pronouncement of divorce, the basic regulations of separate proceedings in matrimonial cases were discussed. On the basis of the institution of the judicial law of evidence, the following evidence has been presented in particular: hearing evidence of the parties, testimony of witnesses, community interview, expert opinion, as well as the most debatable evidence from Facebook, recordings of telephone conversations of the spouses or their correspondence.
