Naruszenia dóbr osobistych w Internecie

Celem niniejszej pracy było zwrócenie uwagi na naruszenia dóbr osobistych w Internecie. Z racji na jego specyficzny, aterytorialny charakter, w sprawach internetowych powstaje wiele wątpliwości prawnych, które zostały w tej pracy poruszone. W pracy zostały przedstawione jedynie wybrane problemy związane z rozstrzyganiem przez sądy polskie i międzynarodowe sporów, których przedmiotem są naruszenia dóbr osobistych w Internecie. Oprócz tego szczególną uwagę poświęcono jurysdykcji krajowej, odpowiedzialności za naruszenie oraz środkom ochrony dóbr osobistych. Ze względu na stale rozwijającą się technologię, przedstawione zostały nie tylko tradycyjne formy naruszenia dóbr osobistych, które mogą występować w świecie rzeczywistym i internetowym, ale także takie, które są charakterystyczne jedynie dla Internetu. Praca miała na celu przedstawić nie tylko teoretyczne zagadnienia dotyczące dóbr osobistych w ogóle, ale wskazać jak należy postępować w praktyce i jakich środków może użyć osoba, kiedy jej dobra osobiste są naruszone lub zagrożone w Internecie.

The object of this thesis was to draw attention to violations of personal rights on the Internet. Due to its specific aterritorial nature, many legal doubts arise in Internet cases, which are addressed in this thesis. The thesis presents only selected problems related to the settlement by Polish and international courts of disputes involving violations of personal rights on the Internet. In addition, special attention has been paid to domestic jurisdiction, liability for violation and means of protecting personal rights. Due to the ever-evolving technology, not only the traditional forms of personal rights violations that can occur in the real and online worlds, but also those that are specific only to the Internet are presented. The thesis aimed to present not only the theoretical issues of personal rights in general, but to indicate how to proceed in practice and what measures a person can use when his personal rights are violated or threatened on the Internet.
