Charakterystyka prawna i funkcje Zintegrowanego Planu Inwestycyjnego

Niniejsza praca poświęcona jest analizie struktury prawnej i funkcji tytułowego zintegrowanego planu inwestycyjnego. Rozważania poprzedza refleksja nad obecnym stanem planowania przestrzennego w Polsce. Następnie praca przybliża powody wprowadzenia go do porządku prawnego oraz zadania jakie ma w nim pełnić. Analizie poddano przepisy regulujące procedurę wnioskowania, sporządzania i uchwalania zintegrowanego planu inwestycyjnego, a także etap negocjacji pomiędzy gminą a inwestorem. Opisano także charakterystyczną dla ZPI umowę urbanistyczną. Praca zwraca uwagę na istniejące problemy, nieścisłości i potencjalne zagrożenia, mogące wystąpić przy jego procedowaniu, proponując jednocześnie stosowne rozwiązania. Zwrócono uwagę na podobieństwa, różnice i wzajemne oddziaływanie na siebie zintegrowanego planu inwestycyjnego, miejscowego planu rewitalizacji a także uchwały o ustaleniu lokalizacji inwestycji mieszkaniowej. Podjęto także próbę rozstrzygnięcia, która z możliwych do wyboru procedur dla realizacji inwestycji mieszkaniowej wydaje się być aktualnie najkorzystniejsza. W pracy przedstawiono również opinie środowiska prawniczego na temat nowego narzędzia planistycznego jakim są zintegrowane plany inwestycyjne, wyszczególniając perspektywę zarówno inwestorów, jak i samorządów.

This thesis analyses the legal structure and functions of the titular integrated investment plan. The considerations are preceded by a reflection on the current state of spatial planning in Poland. The thesis then outlines the reasons for its introduction into the legal system and the tasks it is expected to perform within it. It analyses the legislation regulating the procedure of application, preparation and enactment of the integrated investment plan, as well as the stage of negotiations between the municipality and the investor. The urban planning contract characteristic of the IIP is also described. The study draws attention to the existing problems, inaccuracies and potential risks that may occur during its procedure, while proposing appropriate solutions. Similarities, differences and interactions between the integrated investment plan, the local revitalisation plan and the resolution on determining the location of a housing investment have been pointed out. An additional approach was taken to decide which of the possible procedures for the realisation of a housing investment seems to be the most favourable at present. The thesis also presents opinions of the legal community on the new planning tool of integrated investment plans, detailing the perspective of both investors and local governments.
