Polski porządek prawny w okresie pandemii koronawirusa w kontekście myśli Carla Schmitta

Przedmiotem pracy jest analiza skomplikowanego i niejednorodnego polskiego porządku prawnego w trakcie pandemii koronawirusa za pomocą myśli filozoficzno-prawnej Carla Schmitta. Na początku przedstawiona jest charakterystyka rzeczywistości pandemii ze szczególnym uwzględnieniem naruszeń procesu stanowienia i stosowania prawa, oraz omówieniem problemów wyborów prezydenckich w 2020 r. Drugi rozdział wskazuje i omawia najważniejsze pojęcia myśli Carla Schmitta z okresu lat 20 XX wieku w odniesieniu do tematyki prawa i państwowości. Rozdział trzeci stanowi najważniejszą część pracy, bowiem podjęte zostały w nim rozważania na temat oceny polskiego porządku prawnego w okresie pandemii z perspektywy doktryny niemieckiego prawnika, ze wskazaniem szeregu trudności, z którymi musi zmierzyć się współczesna nauka o prawie.

The subject of the thesis is the analysis of the complex and heterogeneous Polish legal order during the coronavirus pandemic in the context of the philosophical and legal thought of Carl Schmitt. The first chapter contains a brief characteristics of the reality of the pandemic, with particular emphasis on violations of the law-making process and the application of law, as well as a short discussion regarding the 2020 presidential elections. The second chapter provides an introduction into Carl Schmitt’s philosophy from the 1920s in relation in relation to the aspects of law and statehood. The third chapter is the central part of the thesis as it reflects on the possibility of the assessment of the Polish legal order during the pandemic from the perspective of the German lawyer's doctrine, indicating a number of difficulties that modern legal science must face.
