Dowód sprzeczny z prawem w procesie cywilnym

dc.abstract.enThe premise of this paper is to present the subject of illegal evidence. It covers the explanation of the conceptual grid, including deliberations on the meaning and correct definitions for illegal evidence. This aims to identify the most adequate name for the topic under discussion in view of the conceptual diversity. Furthermore, the paper addresses the problem of the procedural functioning of this type of evidence together with a comparison of the institution in question with selected constitutional principles. The work presents the positions of the doctrine which address the title issue, together with their justification. The dissertation also includes a discussion of the constitutional values closely linked to illegal evidence. These intersect with the title topic and, in view of their fundamental role in the Polish legal system, require thorough discussion in this context.
dc.abstract.plZałożeniem pracy jest przedstawienie tematyki dowodów sprzecznych z prawem. Obejmuje ona wyjaśnienie siatki pojęciowej, w tym rozważania na temat znaczenia i prawidłowego określenia dla dowodów sprzecznych z prawem. Ma to na celu wskazania najbardziej adekwatnej nazwy dla omawianej tematyki wobec różnorodności pojęciowej. Ponadto w pracy jest poruszany problem procesowego funkcjonowania tego rodzaju dowodów wraz z zestawieniem przedmiotowej instytucji z wybranymi zasadami konstytucyjnymi. Praca prezentuje stanowiska doktryny poruszające tytułową problematykę wraz z ich uzasadnieniem. Dysertacja obejmuje również omówienie wartości konstytucyjnych ściśle powiązanych z dowodami sprzecznymi z prawem. Przenikają się one z tytułową tematyką i wobec ich fundamentalnej roli w polskim systemie prawnym wymagają dokładnego omówienia w tym kontekście.
