Działanie w interesie społecznym jako okoliczność wyłączająca bezprawność działania naruszającego dobra osobiste

dc.abstract.enThe Master's thesis addresses the issue of the coexistence of the two values: the public interest and the personal rights of each person. Actions in the public interest may infringe personal rights, however, due to the motives of such actions, the unlawfulness of the of the infringing behaviour may be excluded. The paper describes the issue of the exclusion of unlawfulness referred to in Article 24 of the Civil Code due to acting in the public interest. The results of the analysis of the Supreme Court case law concerning the circumstances of acting in the public interest are presented. By comparing various factual situations and court decisions, the requirements that must be met in order to demonstrate that a certain behaviour was not unlawful for the sake of acting in the social interest are presented, with particular emphasis on the role of the press in fulfilling its controlling function and ensuring that citizens have sufficient access to information.
dc.abstract.plPraca dotyczy zagadnienia współistnienia dwóch wartości, jakimi są interes społeczny i przysługujące każdej osobie dobra osobiste. Działania w interesie społecznym mogą naruszać dobra osobiste, jednakże ze względu na motywy takich działań, bezprawność zachowania naruszającego dobro osobiste może zostać wyłączona. W pracy opisano zagadnienie wyłączenia bezprawności, o którym mowa w art. 24 k.c., z uwagi na działanie w interesie społecznym. Zaprezentowano wyniki analizy orzecznictwa Sądu Najwyższego dotyczącego okoliczności działania w interesie społecznym. Porównawszy różne stany faktyczne i rozstrzygnięcia sądów, przedstawiono wymagania, które muszą zostać spełnione, by wykazać, że określone zachowanie nie było bezprawne przez wzgląd na działanie w interesie społecznym, ze szczególnym uwzględnieniem roli prasy w realizowaniu funkcji kontrolnej i zapewnieniu obywatelom należytego dostępu do informacji.
