Przejęcie i przekazanie ścigania karnego - zarys problematyki

dc.abstract.enThe presented work is devoted to the problem of taking over or transferring the criminal prosecution. This work consists of four chapters. The first one discusses the historical origin of the institution in question, including its source deriving from extradition, bi- and multilateral international agreements and the regulations contained in the 1969 Code of Criminal Procedure. The second chapter treats the provisions currently in force in domestic law that regulate the described issue, taking into account the issues that spark controversy, such as, among others, the legal nature of the Minister of Justice's decisions on the taking over or transferring the criminal prosecution, the challengeability of these decisions and the mode of surrender of the prosecuted persons. The third chapter describes the international agreements linking Poland with selected countries insofar as they relate to the taking over or transferring the criminal prosecution. The relationship between the provisions of these agreements and domestic legislation is also analysed. The last chapter contains an assessment of the institution in question from the point of view of the Strasbourg standard of protection of human rights, with particular attention paid to the way in which the time limits for pre-trial detention are calculated and to the admission in the Polish criminal process of evidence carried out by foreign authorities.
dc.abstract.plNiniejsza praca została poświęcona problematyce przejęcia i przekazania ścigania karnego. Praca składa się z czterech rozdziałów. W pierwszym z nich omówiono historyczne pochodzenie przedmiotowej instytucji, uwzględniając przy tym jej źródło wypływające z ekstradycji, bi- i multilateralne umowy międzynarodowe oraz regulacje zawarte w Kodeksie postępowania karnego z 1969 roku. Drugi rozdział traktuje o obecnie obowiązujących w prawie krajowym przepisach normujących opisywane zagadnienie, z uwzględnieniem kwestii wywołujących w nauce prawa kontrowersje, takich jak m. in. charakter prawny rozstrzygnięć Ministra Sprawiedliwości w zakresie przejęcia i przekazania ścigania karnego, zaskarżalność tych rozstrzygnięć oraz tryb wydawania osób ściganych. W rozdziale trzecim opisano umowy międzynarodowe łączące Polskę z wybranymi państwami w zakresie, w jakim dotyczą one przejęcia i przekazania ścigania karnego. Poddano także analizie relację pomiędzy postanowieniami tych umów a przepisami krajowymi. Ostatni rozdział zawiera ocenę omawianej instytucji z punktu widzenia strasburskiego standardu ochrony praw człowieka ze szczególnym uwzględnieniem sposobu liczenia terminów tymczasowego aresztowania oraz dopuszczenia w polskim procesie karnym dowodów przeprowadzonych przez organy zagraniczne.
