Ochrona praw ludów rdzennych w świetle orzecznictwa Komitetu Praw Człowieka ONZ

dc.abstract.enThe subject of the thesis is the analysis of the protection of the rights of indigenous peoples guaranteed under the International Covenant on Civil and Political Rights. Described is the evolution of the formation of the rights of indigenous peoples and the history of efforts by the international community to enable members of indigenous peoples to participate in decision-making processes concerning them, taking into account the international agreements concluded. The organizational structure, powers and rules of operation of the Human Rights Committee are presented, in particular, the procedure of individual complaint, which is an instrument of protection to which individuals are entitled. The work analyzes the decisions issued by the Human Rights Committee on violations experienced by members of indigenous peoples in order to answer the question of whether the individual complaint is a sufficient means to effectively assert rights under the International Covenant on Civil and Political Rights. Contemporary challenges to the international protection of the rights of indigenous peoples are also discussed.
dc.abstract.plPrzedmiotem pracy magisterskiej jest analiza ochrony praw ludów rdzennych gwarantowanej na podstawie Międzynarodowego Paktu Praw Obywatelskich i Politycznych. Opisana została ewolucja kształtowania się praw ludów rdzennych i historia działań podejmowanych przez społeczność międzynarodową na rzecz umożliwienia członkom ludów rdzennych udziału w dotyczących ich procesach decyzyjnych, z uwzględnieniem zawartych umów międzynarodowych. Przedstawiono strukturę organizacyjną, kompetencje i zasady funkcjonowania Komitetu Praw Człowieka, w szczególności procedurę skargi indywidualnej będącej instrumentem ochrony przysługującym jednostkom. W pracy poddane analizie zostały decyzje wydane przez Komitet Praw Człowieka dotyczące naruszeń doświadczanych przez członków ludów rdzennych w celu odpowiedzenia na pytanie, czy skarga indywidualna jest wystarczającym środkiem do skutecznego dochodzenia praw na podstawie Międzynarodowego Paktu Praw Obywatelskich i Politycznych. Omówione zostały także współczesne wyzwania stojące przed międzynarodową ochroną praw ludów rdzennych.
