Mainstreaming the right to health across EU migration policies: a normative analysis of the EU Asylum and Migration Pact (2023)

dc.abstract.enThe right to health to the EU Charter clearly establishes that everyone shall have the right of access to preventive health care and medical treatment. This right is deeply interconnected and interrelated to other rights, including the right to water, food, housing and non-discrimination, among others. Migrants are an extremely vulnerable group to physical and mental illnesses however they often face discrimination and barriers to accessing healthcare in the EU. The protection of migrants’ physical and mental health is one of the fundamental objectives of the Sustainable Development Goals. In this regard, many guidelines and recommendations have been issued by EU bodies and international organizations, advocating for a human rights-based approach to EU migration frameworks. In May 2024, the European Parliament and the Council officially adopted the new Pact on Migration and Asylum, including new Regulations and Directives setting out rules and standards for the treatment of migrants applying for international protection. This thesis analyzes the provisions of the Pact relating to the initial ‘entry’ phase of migration, including the Screening Regulation, the Asylum Procedure Regulation and the Reception Conditions Directive, in order to determine whether they strike an appropriate balance between the protection of migrants’ rights and the interests of national security. In order to achieve this objective, the thesis explains the origins and significance of the right health and its relevance in the realm of migration. This is followed by an in depth analysis of the EU Migration and Asylum Pact’s provisions on ‘entry’ and on how such provisions account for the migrants’ fundamental rights, with specific focus on the right to health. Additionally this thesis provides recommendations for the implementation of the Pact at national level in order to provide guidance on the necessary guarantees needed in order to achieve full respect of migrants’ fundamental rights and to achieve the goals on universal health coverage set out by the SGDs. From the analysis it emerges that the EU is far from achieving the goals set out by the SDGs. While the new EU Pact on Migration and Asylum includes welcome safeguards for the reception conditions and guarantees to legal and healthcare-related support for migrants, the Pact also includes provisions that have the potential to put put migrants’ fundamental rights at serious risk, including the provision establishing the legal fiction of non-entry and the accelerated border procedures established by the new Asylum Procedure Regulation.
dc.abstract.plPrawo do zdrowia w Karcie UE stanowi, że każdy ma prawo dostępu do profilaktycznej opieki zdrowotnej i leczenia. Prawo to jest głęboko powiązane z innymi prawami, w tym prawem do wody, żywności, mieszkania i niedyskryminacji. Migranci, którzy są grupą podatną na choroby fizyczne i psychiczne często spotykają się z dyskryminacją i barierami w dostępie do opieki zdrowotnej w UE. Ochrona zdrowia fizycznego i psychicznego migrantów jest jednym z podstawowych priorytetów Celów Zrównoważonego Rozwoju (SDG). W tym względzie organy UE i organizacje międzynarodowe wydały wiele wytycznych i zaleceń, opowiadając się za podejściem opartym na prawach człowieka do ram migracyjnych UE. W maju 2024 r. Parlament Europejski i Rada oficjalnie przyjęły nowy Pakt w sprawie migracji i azylu, w tym nowe rozporządzenia i dyrektywy określające zasady i normy dotyczące traktowania migrantów ubiegających się o ochronę międzynarodową. Niniejsza praca analizuje przepisy Paktu dotyczące początkowej fazy „wjazdu” migracji, w tym rozporządzenie w sprawie kontroli, rozporządzenie w sprawie procedury azylowej i dyrektywę w sprawie warunków przyjmowania, aby ustalić, czy zapewniają one odpowiednią równowagę między ochroną praw migrantów a interesami bezpieczeństwa narodowego. Aby osiągnąć ten cel, praca wyjaśnia pochodzenie i znaczenie praw do ochrony zdrowia oraz jego znaczenie w sferze migracji. Ponadto dogłębna analiza przepisy Paktu UE w sprawie migracji i azylu dotyczących „wjazdu” oraz tego, w jaki sposób takie przepisy uwzględniają podstawowe prawa migrantów, ze szczególnym uwzględnieniem prawa do zdrowia. Ponadto praca ta zawiera zalecenia dotyczące wdrażania Paktu na szczeblu krajowym w celu zapewnienia wskazówek dotyczących niezbędnych gwarancji potrzebnych do osiągnięcia pełnego poszanowania podstawowych praw migrantów i osiągnięcia celów dotyczących powszechnego ubezpieczenia zdrowotnego określonych w SGD. Z analizy wynika, że ​​UE jest daleka od osiągnięcia celów określonych w SDGs. Chociaż nowy pakt UE w sprawie migracji i azylu obejmuje pewne zabezpieczenia dotyczące warunków przyjmowania oraz gwarancje wsparcia prawnego i opieki zdrowotnej dla migrantów, Pakt zawiera również przepisy, które mogą poważnie zagrozić podstawowym prawom migrantów, w tym przepis ustanawiający fikcję prawną „nie wjazdu” i przyspieszone procedury graniczne ustanowione w nowym rozporządzeniu w sprawie procedury azylowej.
