Umorzenie postępowania przygotowawczego dotyczącego przestępstwa posiadania narkotyków. Analiza akt Prokuratury Rejonowej w Wieluniu

dc.abstract.enThe subject of the master thesis concentrates on the discontinuation of preparatory proceedings regarding the crime of drug possession. The purpose of this research is to analyze the course of such proceedings and to look at the characteristics of the suspects. The study includes descriptions of different types of substances, the reasons for using drugs and the mechanism of addiction. The author discussed the process of changing legal regulations and describes the current regulations of The Act of Law of 29 July 2005 on Counteracting Drug Addiction. There are also presented statistical data about drug crime in Poland. To achieve the aim of the thesis, the author collected data from the prosecutor's files. The research was carried out at the District Prosecutor's Office in Wielun. After reviewing the files, the author analyzed the informations. The master thesis ends with conclusions about the collected data and considerations of the prosecutor's office's restrictive approach to the crime of drug possession.
dc.abstract.plTematem pracy jest umorzenie postępowania przygotowawczego, dotyczącego przestępstwa posiadania narkotyków. Celem pracy jest analiza przebiegu takiego postępowania oraz przyjrzenie się charakterystyce podejrzanych. W pracy opisano rodzaje substancji, przedstawiono przyczyny sięgania po narkotyki czy mechanizm uzależnienia. Omówiono proces kształtowania się przepisów prawnych dotyczących posiadania zakazanych substancji w Polsce oraz obecnie obowiązującą ustawę o przeciwdziałaniu narkomanii z 29 lipca 2005 roku. Ukazano również dane statystyczne na temat przestępczości narkotykowej w Polsce oraz jej sprawcach. Aby osiągnąć cel pracy, wykorzystana w tym celu została metoda badań aktowych. Badania przeprowadzono w Prokuraturze Rejonowej w Wieluniu. Po zapoznaniu się z aktami, dokonano szczegółowej analizy materiału. Pracę kończą wnioski dotyczące zebranych danych o postępowaniu i o sprawcach, a także rozważania na temat restrykcyjnego podejścia prokuratury do przestępstwa posiadania narkotyków.
