DECYZJA O ŚRODOWISKOWYCH UWARUNKOWANIACH W PROCESIE INWESTYCYJNO-BUDOWLANYM

dc.abstract.enThe thesis focuses mainly on the analysis of the topic of the decision on the environmental conditions, which has a crucial role in the investment and construction process. As an introduction, the author points out the interdisciplinary nature of the undertaken topic and defines the structure and purpose of the thesis. The thesis is divided into four parts, where at the beginning the main aspects of the decision on the environmental conditions are discussed. Then the author proceeds to an analysis of the essential terminology and conceptual grid for the undertaken subject. In the third chapter, there is analyzed the procedure for issuing a decision on the environmental conditions and all issues closely related to this procedure. In the fourth chapter, the author presents the impact of the decision on the environmental conditions on further investment decisions and identifies practical problems in the application of environmental regulations. The thesis is an analysis of the law regulations, doctrinal standpoints and administrative court rulings, shows how some of the described institutions are applied in practice and proposes de lege ferenda postulates to improve the procedure for issuing decisions on the environmental conditions within the investment process.
dc.abstract.plPraca skupia się przede wszystkim na analizie zagadnienia decyzji o środowiskowych uwarunkowaniach, odgrywającej kluczową rolę w procesie inwestycyjno-budowlanym. Autorka na wstępie wskazuje na interdyscyplinarny charakter podejmowanego tematu oraz określa strukturę oraz cel pracy. Praca została podzielona na cztery części, w których na początku rozwijane są podstawowe zagadnienia związane z decyzją o środowiskowych uwarunkowaniach. Następnie autorka przystępuje do analizy istotnej dla podejmowanej problematyki siatki pojęciowej oraz stosowanej terminologii. W trzecim rozdziale zostaje poddany analizie przebieg postępowania w sprawie wydania decyzji o środowiskowych uwarunkowaniach oraz wszelkie kwestie ściśle związane z tym postępowaniem. W czwartym rozdziale autorka przedstawia wpływ decyzji o środowiskowych uwarunkowaniach na dalsze decyzje inwestycyjne oraz identyfikuje problemy praktyczne w stosowaniu regulacji środowiskowych. Praca stanowi analizę przepisów prawa, stanowisk doktryny oraz orzecznictwa sądów administracyjnych, ukazuje jak niektóre opisywane instytucje znajdują zastosowanie w praktyce, a także proponuje postulaty de lege ferenda, mające na celu usprawnienie procedury wydawania decyzji o środowiskowych uwarunkowaniach w ramach procesu inwestycyjnego.
