Zakaz znęcania się w kontekście zasady ochrony humanitarnej zwierząt

dc.abstract.enThis thesis analyzes the issue of the prohibition of abuse in light of the principle of humanitarian protection of animals in force in Polish law, and examines whether the prohibition of abuse implements the principle of humanitarian protection of animals. The thesis uses the method of historical-legal, comparative and dogmatic analysis of the law. The axiological basis of the principle of humanitarian protection of animals and its development over the centuries are discussed. This is followed by an analysis of the principle of humanitarian protection, its subject area, its importance and the role it plays in ensuring the welfare of animals. The next chapter is followed by an analysis of the crime of animal abuse, its structure, the practice of legislation and related administrative and legal measures aimed at implementing the principle of humanitarian protection. In the next section, the thesis compares the legal status in force in the national order regarding crimes against the humane protection of animals in relation to the legal systems of Germany, the Czech Republic and Slovakia. Finally, de lege lata and de lege ferenda conclusions are formulated regarding the implementation of the principle of humanitarian protection of animals through the prohibition of animal abuse
dc.abstract.plNiniejsza praca dotyczy analizy zagadnienia zakazu znęcania się w świetle obowiązującej w prawie polskim zasady ochrony humanitarnej zwierząt oraz zbadanie, czy zakaz znęcania się realizuje zasadę ochrony humanitarnej zwierząt. W pracy posłużono się metodą historycznoprawną, komparatystyczną oraz dogmatyczną analizą prawa. Omówione zostają podstaw aksjologiczne zasady ochrony humanitarnej oraz ich rozwój na przestrzeni wieków. Następnie analizie zostaje poddana zasada ochrony humanitarnej, jej zakres przedmiotowy, znaczenie oraz rola, jaką odgrywa w zapewnieniu dobrostanu zwierząt. W kolejnym rozdziale następuje zbadanie przestępstwa znęcania się nad zwierzętami, jego strukturze, praktyce stosowania przepisów oraz związanych z nimi środków administracyjnoprawnych mających na celu realizację zasady ochrony humanitarnej. W dalszej części pracy porównany zostaje obowiązujący w porządku krajowym stan prawny dotyczący przestępstw przeciwko humanitarnej ochronie zwierząt w stosunku do systemów prawnych Niemiec, Czech i Słowacji. Na końcu sformułowane zostają wnioski de lege lata oraz de lege ferenda dotyczące realizacji zasady ochrony humanitarnej zwierząt przez zakaz znęcania się nad nimi.
