dc.abstract.enThe aim of this thesis is to analyze the non-compete clause during the employment relationship. The thesis consists of three chapters: The first chapter defines the key concepts of the non-compete clause and competitive activity. It also discusses the legal basis for the obligation to refrain from engaging in competitive activities. The second chapter is dedicated to the characteristics of the contract. It analyzes the content of the agreement, its distinctiveness, form, parties, and issues of voluntariness. The final chapter discusses the consequences of breaching the non-compete clause, such as termination of employment, employee's financial liability, and employee's disciplinary liability. The thesis is based on the analysis of labor law regulations, court rulings, and sources from scientific literature.
dc.abstract.plCelem niniejszej pracy jest analiza zakazu konkurencji w czasie trwania stosunku pracy. Praca składa się z trzech rozdziałów: W pierwszym rozdziale zdefiniowane zostały kluczowe pojęcia zakazu konkurencji oraz działalności konkurencyjnej. Omówiono również prawne podstawy obowiązku powstrzymania się od prowadzenia działalności konkurencyjnej. Drugi rozdział poświęcony jest charakterystyce umowy. Przeanalizowano w nim treść umowy, jej odrębność, formę, strony oraz kwestie dobrowolności. W ostatnim rozdziale omówione zostały skutki naruszenia zakazu konkurencji takie jak: rozwiązanie umowy o pracę, odpowiedzialność materialna pracownika oraz odpowiedzialność porządkowa pracownika. Praca bazuje na analizie przepisów prawa pracy, orzecznictwa sądowego oraz literatury naukowej.
