System konstytucyjny Izraela w kontekście reform władzy sądowniczej

dc.abstract.enThis thesis deals with Israel's constitutional system with a particular focus on the role of the judiciary, as well as the reforms of it. These were presented by the Minister of Justice in January 2023 and have caused considerable controversy among legal practitioners, the political class and the Israeli public alike. In this thesis, I describe the constitutional system in Israel, the scope of competences of the authorities, as well as take a closer look at the system of the judiciary and show how the Israeli Constitution came into being in an unusual way and how the competence to review the constitutionality of the laws has evolved. I draw attention to the strong position of the Supreme Court in Israel's constitutional system, its reasons and give voice to its critics. Finally, I detail the judicial power reforms announced in 2023 and subject them to my own assessment. The purpose of the thesis is to present Israel's unique constitutional system and the changes proposed by the government, as well as to assess their potential impact on the judiciary and the constitutional system in Israel. I advance a thesis that the reforms, some of which have taken effect, would have a negative effect on the principles of the tri-partition and balance of powers in Israel by significantly weakening the judiciary. I also provide my own assessment of the causes of the constitutional crisis in Israel and a possible perspective for Israel's constitutional system.
dc.abstract.plNiniejsza praca traktuje o systemie konstytucyjnym Izraela ze szczególnym uwzględnieniem roli władzy sądowniczej, a także o reformach tejże władzy. Zostały one przedstawione przez ministra sprawiedliwości w styczniu 2023 r. i wywołały duże kontrowersje tak wśród praktyków prawa, klasy politycznej, jak i społeczeństwa izraelskiego. W pracy opisuję ustrój konstytucyjny w Izraelu, zakres kompetencyjny władz, a także przybliżam ustrój władzy sądowniczej i przedstawiam, w jak nietypowy sposób powstała Konstytucja Izraela oraz jak kształtowała się kompetencja do kontroli konstytucyjności prawa. Zwracam uwagę na silną pozycję Sądu Najwyższego w ustroju konstytucyjnym Izraela, jej przyczyny oraz oddaję głos jej krytykom. Na koniec przedstawiam szczegółowo zapowiedziane w 2023 r. reformy władzy sądowniczej i poddaję je ocenie własnej. Celem pracy jest przedstawienie wyjątkowego systemu konstytucyjnego Izraela oraz zaproponowanych przez rząd zmian, a także ocena ich potencjalnego wpływu na władzę sądowniczą oraz system konstytucyjny w Izraelu. Stawiam tezę, że reformy, które częściowo weszły w życie, odniosłyby negatywny skutek dla zasad trójpodziału i równowagi władz w Izraelu, znacznie osłabiając władzę sądowniczą. Przedstawiam również własną ocenę przyczyn kryzysu konstytucyjnego w Izraelu i możliwą perspektywę dla ustroju konstytucyjnego Izraela.
