Zasady umieszczania i pobytu w strzeżonych ośrodkach dla cudzoziemców w świetle standardów ochrony praw człowieka

dc.abstract.enThe aim of this master's thesis is to present the terms of confinement and detention in guarded centers for foreigners, to review them in terms of human rights protection, and to analyze their application in practice. This was done through the analysis of international, European Union, and national regulations, with particular emphasis on the ECHR, the Return Directive, the Reception Directive, the Act on Foreigners, and the Act on Granting International Protection to Foreigners on the territory of the Republic of Poland. Special attention was paid to particularly vulnerable groups - unaccompanied minors and individuals with experience of torture and other forms of violence. The thesis also presents alternative measures to detention, along with the perspective of non-governmental organizations on the current system. Subsequently, the regulations were compared with observations made during numerous inspections of guarded centers for foreigners conducted by, among others, the National Preventive Mechanism against Torture (NPM) and the European Committee for the Prevention of Torture (CPT). As a result, many areas were identified where there were violations of individual rights, and potential solutions to current problems were indicated. The jurisprudence of the ECtHR was also analyzed. The research found that Polish courts do not treat detention as a measure of last resort and unreasonably prolong the period of detention, which consequently leads to a violation of the right to liberty (Article 5 ECHR) and the right to respect for family life (Article 8 ECHR). Observations made by human rights organizations indicate that, in connection with the crisis on the Polish-Belarusian border, there may also have been a violation of the prohibition of inhuman treatment (Article 3 ECHR).
dc.abstract.plCelem niniejszej pracy magisterskiej jest przedstawienie zasad umieszczania i pobytu w strzeżonych ośrodkach dla cudzoziemców, zrewidowanie ich pod względem ochrony praw człowieka oraz przeanalizowanie ich stosowania w praktyce. Przeprowadzono to poprzez analizę przepisów międzynarodowych, unijnych oraz krajowych, z wyszczególnieniem EKPC, dyrektywy powrotowej, dyrektywy recepcyjnej, ustawy o cudzoziemcach oraz ustawy o udzielaniu cudzoziemcom ochrony międzynarodowej na terytorium RP. Specjalna uwaga została zwrócona na grupy szczególnie wrażliwe- małoletni pozostający bez opieki oraz osoby z doświadczeniem tortur i innych form przemocy. W pracy przedstawiono również środki alternatywne do detencji wraz ze spojrzeniem organizacji pozarządowych na obecny system. Następnie zestawiono przepisy z obserwacjami dokonanymi podczas licznych wizytacji strzeżonych ośrodków dla cudzoziemców przeprowadzonych przez m.in. KMPT oraz CPT. W konsekwencji zidentyfikowano wiele obszarów, w których występowało naruszenie praw jednostek, a następnie wskazano potencjalne rozwiązania obecnych problemów. Przeanalizowano również orzecznictwo ETPC. W wyniku badań stwierdzono, iż polskie sądy nie traktują detencji jako środka ostatecznego oraz bezprzedmiotowo przedłużają okres detencji, co w konsekwencji prowadzi do naruszenia prawa do wolności (art. 5 EKPC) oraz prawa do poszanowania życia rodzinnego (art. 8 EKPC). Z obserwacji przeprowadzonych przez organizacje zajmujące się ochroną praw człowieka wynika, że w związku z kryzysem na granicy polsko-białoruskiej mogło również dojść do naruszenia zakazu nieludzkiego traktowania (art. 3 EKPC).
