Wpływ dostępu do informacji publicznej na rozwój partycypacji obywatelskiej w Polsce na tle europejskim
| dc.abstract.pl | Przedmiotem rozprawy doktorskiej jest analiza istniejącego modelu udostępniania informacji publicznych. Zasadniczym celem teoretycznym rozprawy jest wykazanie wpływu obowiązującego w Polsce modelu dostępu do informacji publicznej na rozwój partycypacji obywatelskiej oraz identyfikacja najistotniejszych barier w przedmiotowym zakresie. Jako główny cel badawczy przyjęto dokonanie analizy obowiązujących w Polsce rozwiązań z zakresu teorii i praktyki udostępniania informacji publicznej, oraz ukazanie wpływu obowiązującego modelu dostępu do informacji publicznej na system demokratyczny. Realizację prawa do informacji badano zakładając, że stanowi ono pewnego rodzaju instytucję prawną, która z jednej strony przysługuje obywatelom i ich grupom, lecz z drugiej podlega pewnym ograniczeniom mającym na celu chociażby ochronę interesu państwa, wpływając jednocześnie na zachodzące w nim procesy polityczne. Zadania badawcze miały na celu konceptualizację podstawowych pojęć oraz analizę roli prawa dostępu do informacji w życiu obywateli i wspólnot. Główna część pracy dotyczy regulacji prawnych z zakresu prawa dostępu do informacji w Polsce na tle europejskim co pozwoliło na wskazanie istniejących dysfunkcji wśród polskich rozwiązań. Konsekwencją tych wyjaśnień jest projekcja możliwych skutków wprowadzenia zmian w przedmiotowym zakresie. Przedmiotem rozważań była również rola obywatelskiego wymiaru dostępu do informacji publicznej, w tym w szczególności funkcje realizowane przez media i organizacje pozarządowe. Na koniec pracy sformułowano również możliwe warianty dalszego rozwoju instytucji prawa do informacji w Polsce. |
| dc.abstract.pl | The subject of the doctoral dissertation is the analysis of the current access to public information system. The fundamental theoretical aim of the study was to show the influence of the existing model of access to public information in Poland on the development of civic participation and to identify the most significant barriers in this respect. The main research objective was to analyse the solutions in force in Poland in the field of theory and practice of providing access to public information, and to show the influence of the existing model of access to public information on the democratic system. The implementation of the right to information was examined assuming that it is a kind of legal institution which, on the one hand, is vested in citizens and their groups, but on the other hand, it is subjected to certain restrictions aimed at, for example, protecting the interest of the state while influencing the political processes taking place in it. The research tasks were aimed at conceptualizing basic concepts and analysing the role of the right of access to information in the lives of citizens and communities. The main part of the work concerns legal regulations in the field of the right to access information in Poland against the European background, which allowed to indicate existing dysfunctions among the Polish solutions. The consequence of these explanations is the projection of the possible effects of introducing changes in the subject matter. The subject of consideration was also the role of the civic dimension in access to public information, including in particular the functions performed by the media and non-governmental organizations. At the end of the dissertation possible variants of further development of the institution of the right to information in Poland were formulated. |
