Reguła rebus sic stantibus versus pacta sunt servanda. Próba hierarchizacji.

dc.abstract.enThe topic of the tesis is the rule rebus sic stantibus, its meaning in the context of other provisions and principles of the Civil Code, with particular emphasis on the principle of pacta sunt servanda. The work also includes a short historical analysis of the presence and development of the subject matter over the years both in the law of European countries and in Poland. A detailed analysis of Article 357¹ of the Civil Code was carried out. The topic of the shape and practical application of the rule in individual cases was also discussed. An important element of the work is also the author's polemic with the opinions of opinion-forming representatives of civil law in Poland regarding the subject matter. De lege ferenda proposals were also indicated.
dc.abstract.plTematem pracy jest reguła rebus sic stantibus, jej znaczenie w kontekście innych przepisów i zasad Kodeksu cywilnego, ze szczególnym uwzględnieniem zasady pacta sunt servanda. Swoje miejsce w pracy znalazła też krótka analiza historyczna obecności i rozwoju przedmiotowego zagadnienia na przestrzeni lat zarówno w prawie państw europejskich, jak i w Polsce. Przeprowadzona została szczegółowa analiza artykułu 357¹ Kodeksu cywilnego. Podjęto również temat kształtu i praktycznego zastosowania reguły w poszczególnych przypadkach. Ważnym elementem pracy jest także polemika jej autora z opiniami opiniotwórczych przedstawicieli prawa cywilnego w Polsce w zakresie przedmiotowego zagadnienia. Wskazano również propozycje de lege ferenda.
