Eugenika: historia idei, wpływ na wybrane systemy normatywne, problematyka współczesna i prawo polskie
| dc.abstract.en | This dissertation discusses the subject of eugenics, defined as the idea of improving the biological condition of the human species through selective measures, analyzed in terms of its legal implications within the sub-discipline of the history of political and legal doctrines. The work is divided into a historical section, covering the genesis and the development of the eugenics movement up to 1945, with particular emphasis on the ideological transformations and practical implications within the normative systems of the United States of America, Germany and the Second Polish Republic. Subsequently, the section on the contemporary problems of the issue analyzes the post-war discourse on eugenics and examines the norms of Polish law that are or can be associated with it. The main research problem of the dissertation is a cross-sectional analysis of eugenics as a separate current of political-legal thought, discussing whether it qualifies as an independent doctrine or ideology. Further, the author of the work attempts to answer the question of the genesis of eugenics thought, the reasons for its popularity, presenting its impact on the normative systems and political practice of selected countries in the period up to 1945. In addition, the author of the dissertation undertakes to approach the eugenic thought not only as a dead ideological current of the first half of the 20th century, but as an idea that is also present in contemporary discourse and a reference point for the norms of the Euro-Atlantic area of legal culture. Finally, the work addresses the question of whether contemporary Polish law includes norms directly derived from or related to eugenic thought. |
| dc.abstract.pl | Przedmiotem pracy jest eugenika, rozumiana jako idea poprawy biologicznej gatunku ludzkiego w drodze metod selekcyjnych, analizowana z perspektywy implikacji prawnych, w ramach subdyscypliny historii doktryn politycznych i prawnych. Praca rozpoczyna się częścią historyczną, obejmującą genezę i rozwój ruchu eugenicznego do roku 1945, ze szczególnym uwzględnieniem przemian ideowych i praktycznych implikacji w systemach normatywnych Stanów Zjednoczonych Ameryki, Niemiec oraz II Rzeczypospolitej Polskiej. Następnie część dotycząca współczesnej problematyki zagadnienia analizuje powojenny dyskurs dotyczący eugeniki oraz pochyla się nad tymi unormowaniami prawa polskiego, które są lub mogą być z nią wiązane. Podstawowym problemem badawczym pracy jest przekrojowa analiza eugeniki jako odrębnego nurtu myśli polityczno-prawnej, a w konsekwencji odpowiedź na pytanie, czy daje się on zakwalifikować jako samodzielna doktryna lub ideologia. W dalszej kolejności, praca próbuje znaleźć odpowiedź na pytanie o genezę myśli eugenicznej, powody jej atrakcyjności oraz przedstawić wpływ na systemy normatywne i praktykę polityczną wybranych państw w okresie do 1945 roku. Praca podejmuje się ponadto spojrzenia na myśl eugeniczną nie tylko jako martwy prąd ideowy pierwszej połowy XX. wieku, ale jako nurt obecny także we współczesnym dyskursie oraz punkt odniesienia dla norm prawa euroatlantyckiego obszaru kultury prawnej. Ostatnim istotnym problemem podejmowanym przez pracę jest próba odpowiedzi na pytanie, czy we współczesnym prawie polskim funkcjonują unormowania wynikające wprost z myśli eugenicznej lub z nią związane. |
