Analiza porównawcza obowiązków pracodawcy i obowiązków podmiotu zatrudniającego w sferze cywilnoprawnej w wybranych aspektach

dc.abstract.enThe subject of the master's thesis is a comparative analysis of the obligations of the employer and the employing entity in the civil law sphere. Due to the multi-faceted nature of the issues of employers' obligations, a comparative analysis was carried out on the obligations of employing entities in selected aspects: in terms of establishing an employment relationship, payment of remuneration and in terms of terminating the employment relationship. This work presents the most important obligations of the employer in the employment relationship and the employer in the civil law sphere towards the employed person and administrative authorities, based on the current legal status, numerous case law and professional literature. Moreover, the work discusses the issue of establishment of legal relation of an employment relationship, which affects the scope of obligations the employer should have. Establishing an appropriate basis for employment by the parties affects the rights of the hires which are the weaker party to the employment relationship. The work is also paid special attention to the issue of minimum renumeration and minimum hourly rate, the primary function of which is to ensure fair renumeration for employees.
dc.abstract.plPrzedmiotem pracy magisterskiej jest dokonanie analizy porównawczej obowiązków pracodawcy i podmiotu zatrudniającego w sferze cywilnoprawnej. Ze względu na wieloobszarowość problematyki obowiązków zatrudniających, analiza porównawcza została przeprowadzona na obowiązkach podmiotów zatrudniających w wybranych aspektach: w zakresie nawiązania stosunku zatrudnienia, wypłacania wynagrodzenia oraz w zakresie ustania stosunku zatrudnienia. Niniejsza praca przedstawia najważniejsze obowiązki zatrudniającego w stosunku pracy i zatrudniającego w sferze cywilnoprawnej w stosunku do osoby zatrudnionej oraz organów administracji, na podstawie aktualnego stanu prawnego, licznego orzecznictwa oraz fachowej literatury. Ponadto, w pracy omawiane jest zagadnienie ustalenia istnienia stosunku pracy, które ma wpływ na to, jaki zakres obowiązków powinien mieć zatrudniający. Ustalenie odpowiedniej podstawy zatrudnienia przez strony rzutuje na uprawnienia podmiotu zatrudnianego będącego słabszą stroną stosunku zatrudnienia. W pracy szczególną uwagę poświęcono również kwestii minimalnego wynagrodzenia za pracę oraz minimalnej stawki godzinowej, których funkcją podstawową jest zapewnienie godziwej płacy zatrudnionym.
