dc.abstract.enThe aim of this work is to present the ways in which the state reacts to the danger posed by individuals with mental disorders according to the Mental Health Protection Act and the Act on Proceedings Against Persons with Mental Disorders Posing a Threat to the Life, Health or Sexual Freedom of Others. The genesis and social context of the beasts act are outlined, along with the problem of its unconstitutionality from a psychiatric-legal perspective. The subsequent part of the work focuses on reviewing current research and emerging characteristics of offenders from the National Center for Prevention of Antisocial Behavior. In conclusion, the studied population is juxtaposed with a review of criminological theories in a three-dimensional perspective, i.e. biological-psychological-sociological to understand the causes and mechanisms of criminality and develop effective prevention strategies.
dc.abstract.plCelem pracy jest przedstawienie sposobów reakcji państwa na niebezpieczeństwo stwarzane przez osoby z zaburzeniami psychicznymi w rozumieniu ustawy o ochronie zdrowia psychicznego oraz ustawy o postępowaniu wobec osób z zaburzeniami psychicznymi stwarzającymi zagrożenie dla życia, zdrowia lub wolności seksualnej innych osób. Przedstawiono genezę, kontekst społeczny „ustawy o bestiach” oraz problem jej niekonstytucyjności w perspektywie psychiatryczno-prawnej. W dalszej części pracy skupiono się na przeglądzie badań aktowych i wyłaniającej się z nich charakterystyce sprawcy z Krajowego Ośrodka Zapobiegania Zachowaniom Dyssocjalnym. Na zakończenie, badaną zbiorowość zestawiono z przeglądem teorii kryminologicznych w ujęciu trójwymiarowym, tj. biologiczno-psychologiczno-socjologicznym, celem zrozumienia przyczyn i mechanizmów przestępczości oraz opracowania strategii skutecznej prewencji.
