Pozycja ustrojowa organów regulujących energetykę w Polsce - problem niezależności

dc.abstract.enThe study addresses the problem of legal guarantees of independence of two regulatory authorities in the energy area - the President of the OCCP and the President of the ERO. It includes a discussion of the very concept of regulatory authorities with their axiology and historical outline, a dogmatic-legal analysis of the provisions of EU and domestic law relevant to the topic, and an attempt to discuss the independence of the two authorities in material terms through a case study method referring to specific decisions and proceedings. A comparative legal method is used helpfully. The work is supplemented by interviews conducted with the holders of leadership positions within both regulators, academics, practitioners and representatives of market players, in order to fully reflect the picture of the effectiveness of the legal guarantees of the independence of both bodies and to present the essence of the problem as fully as possible. The purpose of the study is to summarize the relevant legal provisions, doctrinal considerations, jurisprudence on the issue of the independence of regulatory bodies, and contrast them with an analysis of the decision-making practice of both bodies and the actual functioning of the institutions over the years.
dc.abstract.plPraca porusza problem prawnych gwarancji niezależności dwóch organów regulacyjnych w obszarze energetyki – Prezesa UOKiK oraz Prezesa URE. Obejmuje ona omówienie samego pojęcia organów regulacyjnych wraz z ich aksjologią oraz rysem historycznym, dogmatycznoprawną analizę przepisów prawa unijnego oraz krajowego istotnych dla tematu oraz próbę omówienia niezależności obu organów w ujęciu materialnym poprzez metodę case study odwołującą się do konkretnych decyzji i postępowań. Pomocniczo stosowana jest metoda prawnoporównawcza. Uzupełnienie pracy stanowią wywiady przeprowadzone z piastunami kierowniczych stanowisk w ramach obu regulatorów, naukowcami, praktykami i reprezentantami podmiotów rynkowych, by w pełni oddać obraz skuteczności prawnych gwarancji niezależności obu organów oraz możliwie najpełniej zaprezentować istotę problemu. Celem pracy jest podsumowanie istotnych dla zagadnienia niezależności organów regulacyjnych przepisów prawnych, rozważań doktryny, orzecznictwa i skonfrontowanie ich z analizą praktyki decyzyjnej obu organów oraz faktycznym funkcjonowaniem instytucji na przestrzeni lat.
