Analiza prawa zabudowy w kontekście postulatu de lege ferenda wprowadzenia w Polsce własności warstwowej

dc.abstract.enThe master thesis concerns the origin of considerations on the doctrine of layer property ownership introduction in Poland. The heritable bulding right is presented and the analysis has been made from a historical perspective by describing the evolution of this law. The origin of heritable building right introduction in Poland, as well as the goals achieved at that time is also a part of the background analysis. Other proposals and solutions implementing the objectives of layer property ownership applicable in other countries, have been also indicated. Institutions similar to heritable bulding right are presented in the thesis and their application has been briefly described. The de lege ferenda postulate of introducing layer property ownership in Poland is summarized, too. Considerations have been also made on the presented draft of the Act of November 10th, 2010 amending the Civil Code and certain other acts introducing heritable building right in Poland. The possible effects of introducing the heritable building right are considered. In the above context, considerations have been made on the relationship between heritable building right and the norms applicable in the legal system. The analysis covered property rights, perpetual usufruct rights, limited property rights and obligation relations. A brief analysis of the difference between layer property ownership and heritable building right is also presented, and finally the question whether the heritable building right allows the introduction of layer property ownership is being discussed, too.
dc.abstract.plW poniższej pracy magisterskiej zaprezentowano genezę rozważań doktryny nad wprowadzeniem w Polsce własności warstwowej. Przedstawiono prawo zabudowy oraz dokonano analizy w ujęciu historycznym, poprzez opisanie ewolucji tego prawa. Zaprezentowano również genezę wprowadzenia prawa zabudowy na ziemiach polskich, a także cele jakie wówczas realizowało. Wskazano ponadto inne propozycje i rozwiązania funkcjonujące w innych państwach, realizujące cele wprowadzenia własności warstwowej. Przedstawiono instytucje podobne do prawa zabudowy oraz opisano ich zastosowanie. Opisano postulat de lege ferenda wprowadzenia w Polsce własności warstwowej. Podjęto również rozważania na temat przedstawionego projektu z dnia 10 listopada 2010 roku ustawy o zmianie ustawy – kodeks cywilny oraz niektórych innych ustaw, wprowadzającej prawo zabudowy. Opisano możliwe skutki wprowadzenia prawa zabudowy. W tym kontekście podjęto rozważania na temat relacji prawa zabudowy względem obowiązujących w systemie prawa norm. Analizie poddano prawo własności, prawo użytkowania wieczystego, ograniczone prawa rzeczowe oraz stosunki obligacyjne. Przedstawiono również odmienność własności warstwowej od prawa zabudowy, rozważając, czy prawo zabudowy umożliwia wprowadzenie własności warstwowej.
