dc.abstract.enThe subject of this master's thesis is to discuss the issue of forced separation of property. Before presenting it, issues related to entering into a marriage (in civil and religious form), the rights and obligations of spouses, the causes and effects of termination of marriage, as well as matrimonial property regimes were presented. In the context of their functioning, compulsory separation of property arises by virtue of a court decision (Article 52 KRO) or ex lege in the event of incapacitation or bankruptcy of one of the spouses, or in the event of a separation of spouses (Articles 53-54 KRO).
dc.abstract.plPrzedmiotem niniejszej pracy magisterskiej jest omówienie zagadnienia przymusowej rozdzielności majątkowej. Przed jej przybliżeniem przedstawione zostały kwestie związane z zawarciem małżeństwa (w formie cywilnej i wyznaniowej), prawami i obowiązkami małżonków, przyczynami i skutkami ustania związku małżeńskiego, a także małżeńskie ustroje majątkowe. W kontekście z ich funkcjonowania przymusowa rozdzielność majątkowa powstaje na mocy orzeczenia sądu (art. 52 KRO) albo ex lege w razie orzeczenia ubezwłasnowolnienia lub ogłoszenia upadłości jednego z małżonków, względnie w przypadku orzeczenia separacji małżonków (art. 53-54 KRO).
