Problem twórcy jako podmiotu praw autorskich w świetle historycznych dyskursów prawno - literackich

dc.abstract.enThe subject of the work is a look at the genesis of copyright vested in the author over the work. It includes a historical analysis of the formative processes of the emergence of copyright from antiquity to the 18th century, using selected examples of countries from the circle of Western Europe, as well as a conceptual analysis of the author's subject from the position of literary theory and sociology in terms of the impact on the reflection of these fields in the law. Due to the limited possibilities and narrower subject scope resulting from the form of the thesis, I will focus in the course of the work on a specific field of work, which is literary work, other fields evoking only on the basis of functional analogy supporting the arbitrary and particularist selection of historical examples.
dc.abstract.plPrzedmiotem pracy jest spojrzenie na genezę praw autorskich przysługujących twórcy wobec dzieła. Obejmuje analizę historyczną procesów formatujących powstawania praw autorskich od starożytności do XVIII wieku na wybranych przykładach państw z kręgu Europy zachodnich oraz analizę pojęciową podmiotu autora z pozycji teorii i socjologii literatury w zakresie wpływu na odbicie tych dziedzin w prawie. Z racji ograniczonych możliwości i węższego zakresu przedmiotowego, wynikającego z formy pracy magisterskiej, skupię się w toku pracy na konkretnej dziedzinie twórczości, jaką jest twórczość literacka, inne dziedziny przywołując jedynie na zasadzie analogii funkcjonalnej, wspierając się na arbitralnym i partykularnym doborem przykładów historycznych.
