Cywilnoprawna ochrona tajemnicy przedsiębiorstwa

dc.abstract.enThis study investigates the civil law protection of trade secrets, considering the planned changes in the legal protection of whistleblowers. The first chapter presents the historical outline, origins and development of protection against unfair competition in the field of protection of confidential information and presents the sources of currently applicable law. The second chapter covers the characteristics of the concept of trade secrets in the Act on Combating Unfair Competition and other legal acts. The third chapter describes the basis of civil liability for trade secret misappropriation. The last chapter contains the current protection of whistleblowers and planned legislative changes.
dc.abstract.plCelem pracy jest omówienie cywilnoprawnej ochrony tajemnicy przedsiębiorstwa z uwzględnieniem projektowanych zmian w zakresie ochrony sygnalistów tzw. whistleblowers. W rozdziale pierwszym przedstawiono rys historyczny, genezę i rozwój ochrony przed nieuczciwą konkurencją w zakresie ochrony poufnych informacji oraz przedstawiono źródła prawa obecnie obowiązującego. Rozdział drugi obejmuje charakterystykę pojęcia tajemnicy przedsiębiorstwa w ustawie o zwalczaniu nieuczciwej konkurencji i innych aktach prawnych. W rozdziale trzecim pracy opisano podstawy odpowiedzialności i modele ochrony. Ostatni rozdział stanowi omówienie dotychczasowej ochrony sygnalistów w szczególności na gruncie przepisów ustawy o zwalczaniu nieuczciwej konkurencji, unijnej harmonizacji i projektowanych zmian na gruncie prawa polskiego, w kontekście ochrony tajemnicy przedsiębiorstwa.
