Ochrona wynajmujących w umowie najmu lokali mieszkalnych

dc.abstract.enThe work concerns the issue of protecting landlords in lease agreements. It discusses ways, methods and procedures to ensure the protection of landlords during the term of the contract and after its termination. The first chapter characterized the institution of renting premises for housing purposes, paying attention to the concept, essence, classification criteria, typology and evolution of this institution in Poland over the 20th and 21st centuries. The second chapter presented the types and mechanisms of renting a residential premises in the Polish legal system, characterizing the subject and subject of the lease agreement for premises for housing purposes, indicating the rights and obligations of the parties based on the general principles of renting residential premises, and then characterizing the specific type of lease to meet housing needs. The third chapter presents how the institution of rent is used by social housing initiatives. It discussed what the commune's housing stock is and indicated the principles of social renting. The chapter also discusses what social rental agencies are and raises issues related to the social housing initiative. The fourth chapter discusses the protection of the landlord's rights in the light of the Act on the Protection of Tenants' Rights, presenting his rights and obligations towards the tenant. The principles of court proceedings for vacating the premises and the principles of enforcing eviction judgments in the light of the Act on the Protection of Tenants' Rights are also described. The legal position of the lessor in individual types of lease agreements was also compared
dc.abstract.plPraca dotyczy problematyki ochrony wynajmujących w umowie najmu. Omówiono w niej sposoby, metody i procedury zapewnienia ochrony wynajmujących w czasie trwania umowy oraz po jej zakończeniu. W pierwszym rozdziale scharakteryzowano instytucje najmu lokalu na potrzeby mieszkaniowe zwracając uwagę na pojęcie, istotę, kryteria klasyfikacji, typologię oraz ewolucję tej instytucji w Polsce na przestrzeni XX i XXI w. W rozdziale drugim zostały przedstawione rodzaje i mechanizmy najmu lokalu mieszkaniowego w polskim porządku prawnym charakteryzując przedmiot i podmiot umowy najmu lokalu na potrzeby mieszkaniowe, wskazując prawa i obowiązki stron na podstawie zasad ogólnych najmu lokalu mieszkalnego, a następie dokonano charakterki szczególnych typu najmu dla zaspokojenia potrzeb mieszkaniowych. W trzecim rozdziale przedstawiono sposób wykorzystania instytucji najmu przez społeczne inicjatywy mieszkaniowe. Omówiono czym jest mieszkaniowy zasób gminy oraz wskazano zasady najmu socjalnego. W rozdziale także omówiono czym są społeczne agencje najmu oraz poruszono kwestie związaną ze społeczną inicjatywą mieszkaniową. W czwartym rozdziale omówiono ochronę praw wynajmującego w świetle ustawy o ochronie praw lokatorów, przedstawiając jego uprawnienia i obowiązki względem najemcy. Opisano również zasady postępowania sądowego o opróżnienie lokalu oraz zasady wykonywania wyroków eksmisyjnych w świetle ustawy o ochronie praw lokatorów. Dokonano również porównania pozycji prawnej wynajmującego w poszczególnych rodzajach umów najmu
